TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated June 24, 2002, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed of Trust Book 1761, at Page 750, Christopher J. Call did convey unto John Ballengee, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Cabell County Courthouse, in Huntington, West Virginia, on September 18, 2019, at 1:30 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Barboursville District, Cabell County, West Virginia, and more particularly described as follows: A certain lot, parcel of tract of land situate in the State of West Virginia, Barboursville District, Cabell County and being all of Lot No. 13 and also the Northwest 1/2 of lot No. 12 of the Lost Valley Subdivision recorded in Map Book 9 Page 181 in the Office of the Clerk of the County Commission of Cabell County, West Virginia, and being more particularly bounded and described as follows: ALL OF LOT NO. 13 BEGINNING at an iron pin found in the Northeast right of way line of Lost Valley Drive and between Lots 13 and 14 of said Subdivision; thence leaving said Lost Valley Drive and with Lot No. 14, North 34 43′ 40″ East 108.01 feet to an iron pin found; thence leaving Lot No. 14, South 59 39′ 00″ East 51.00 feet to an axle found at the Northwest corner of Lot No. 12; thence, with Lot No. 12, South 35 16′ 59″ West 107.54 feet to an iron pin found in the Northwest right of way line of said Lost Valley Drive; thence, leaving Lot No. 12 and with said Lost Valley Drive, North 60 17′ 00″ West 50.00 feet to the place of beginning, containing 5422.0 S.F. or 0.124 acre more or less as surveyed by Jack O. Meenach, Prof. Surveyor. NORTHWEST 1/2 of LOT NO. 12 BEGINNING at an iron pin found in the Northeast right of way line of Lost Valley Drive and between Lots 12 and 13 of said Subdivision; thence, leaving said Lost Valley Drive and with Lot No. 13, North 35 16′ 59″ West 107.54 feet to an axle found; thence, leaving Lot No. 13, South 57 47′ 00″ East 25.00 feet to an iron pin set; thence, severing Lot No. 12, South 57 19′ 38″ West 106.45 feet to an iron pin set in the right of way line of said Lost Valley Drive; thence, with the said right of way line, North 60 17′ 00″ West 25.00 feet to the place of beginning containing 3666.6 S.F. or 0.061 acre more or less, the total acreage conveyed by this description is 8088.6 S.F. or 0.185 acre more or less as surveyed by Jack C. Meenach, Prof. Surveyor and shown on the plat recorded in Deed Book 959, Page 35. The above described lots are the same lots as described and shown on a plat in Map Book 9 Page 181 in the Office of the Clerk of the Cabell County Commission, West Virginia. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 13 Lost Valley Drive, Huntington, WV 25705. AND BEING the same real estate which was conveyed to Christopher J. Call by Deed dated June 24, 2002, from Kimberly Ann Norton, formerly known as Kimberly Ann Ore, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1095, at Page 457. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
