NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 13, 2000, executed by Borrower, Carol Heath Smith aka Carol Ann Smith, to Andrew H. Miller and Bruce A. Toney, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 1633, at Page 122. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 833 Norway Avenue, Huntington, WV 25705. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 31, 2019, of record in the Clerk’s Office in Book 399, Page 560. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 30th day of September, 2019 at 10:45 a.m. All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, shown in blank on a map of Norwood, Huntington, W.Va., a copy of which map is of record in the Office of the Clerk of the County Commission of Cabell County, W.Va., in Map Book No. 2, Map No. 218, being immediately west of and adjoining Lots No. 1 and 10 of said map, and being more particularly described as follows: BEGINNING at a point at the northwesterly corner of Lot No. 1 as shown on said map of Norwood; thence running from said beginning, with the westerly line of Lots No. 1 and 10, S. 0 35′ E. 180.71 feet to a point in the northerly line of Perry Avenue; thence with said line of Perry Avenue, S. 89 17′ W. 50 feet to a point; thence N. 0 35′ W. 20.08 feet to a point; thence N. 1 10′ E. 140.35 feet to a point in the southerly line of Norway Avenue; thence with said Avenue line N. 65 32′ E. 50 feet to the BEGINNING. This description includes the easterly portion of the blank space and the easterly 50 feet of Lot No. 11, as shown on said map of Norwood. Being the same property conveyed to Carol Ann Smith by the Deed dated July 13, 2000 and recorded in Deed Book 1067 at Page 241 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
