NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Joel P. Jones, Jr. , Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Cabell County, West Virginia, and by Deed of Trust dated September 14, 2012, executed by Casey Ventures LLC which deed of trust is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2449 at Page 422, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee together with Joe R. Pyle Auctions will sell the real estate described in the Deed of Trust, at a public auction on September 27, 2019, at Noon (Registration to begin at 11:00 a.m.) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: PARCEL ONE: All those certain lots, pieces or parcels of land, situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of West Walnut Hills, a copy of which map was filed in the Cabell County Commission Clerk’s Office on July 26, 1919, in Map Book 2, as Map 119, as LOT NUMBER TEN (10), and the easterly part of LOT NUMBER ELEVEN (11), and being more particularly bounded and described as follows: BEGINNING at a point in the north line of Norway Avenue at the southerly corner between Lots 9 and 10, as shown on said map; thence with the said line of Norway Avenue, N. 25- 24′ W., 71.62 feet; thence leaving the said line of Norway Avenue, N. 37- 21′ E., 114.28 feet to a point in the south line of a fifteen foot alley; thence with said alley line, S. 48- 53′ E., 61.92 feet to the northerly corner between Lots 9 and 10, as shown on said map; thence with the line between said lots, S. 36- 07′ W., 140.896 feet to the point of BEGINNING. PARCEL TWO: All that certain lot, piece or parcel of ground situate in the City of Huntington, Cabell County, West Virginia, known and designated on a map of West Walnut Hills, a copy of which map was filed in the Cabell County Commission Clerk’s Office on June 26,1919, in Map Book No. 2, as Map No. 119, as LOT NUMBER EIGHT (8), and the easterly eleven (11) feet of LOT NUMBER NINE (9) and being more particularly described as follows: BEGINNING at a point in the north line of Norway Avenue at the corner between Lots 7 and 8 as shown on said map; thence with the said line of Norway Avenue, northwesterly 53.5 feet; thence northeasterly, parallel to and 11 feet westerly from the line between Lots 8 and 9, 149.51 feet to a point in the south line of a 15 foot alley; thence with said alley line, southeasterly 51.19 feet to the northerly corner between said Lots 7 and 8; thence with the line between said lots, southwesterly 161.21 feet to the point of BEGINNING. PARCEL THREE: All that certain lot, piece or parcel of land, situate in the City of Huntington, Gideon District, Cabell County, West Virginia, and known and designated upon that certain Map of West Walnut Hills Sub-Division, recorded in the Cabell County Commission Clerk’s Office, West Virginia on the 26th day of July, 1919, in Map Book No. 2, at Page No. 119, as the westerly Twenty-Nine feet of Lot No. Nine (9). TERMS OF SALE 1. No financing contingencies. Forty Five (45) days to close. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6.
