Embree having been directed by said Court to conduct a judicial sate of the land described below, which has previously been valued by land commissioners at the direction of the Court, said judicial sale will occur on Friday, the 4th day of October, 2019, offer and sale at public auction at the hour of 10:00 a.m., at the south front door of the Putnam County Courthouse, Winfield, West Virginia, all of the following described real estate: 1. The real estate described as 0.11 Acres Nitro Annex, Map/Parcel 226F 0067 0000 0000, Poca District, Putnam County, WV (valued by commissioners at $7,800.00) 7. The real estate described as Prt Lts 17, 18, 19 Nlock B, Haas Addition, Map/Parcel 3 0110 0000 0000, Poca District, Putnam County, WV (valued by commissioners at $15,000.00) Terms and Conditions of Sale Sale will be made subject to all unpaid real property taxes and special assessments, if any, and also subject to any exceptions. reservations, restrictions, covenants, conditions, agreements and easements as found in the chain of title which affect any part of the property aforesaid, specifically including any which may be incorporated by reference in the aforesaid deed. If you claim to be an heir of the estate of Maxxwell Eugene Milbee (date of death 1/17/2013) – you must make any claim for compensation within the time periods prescribed by probate and/or the Circuit Court of Putnam County, and/or as within the partition suit 17-C-150 as documented above, or within said proceeding. 2. If you have liens that are adverse to any said heir you must perfect any such claim within the time periods prescribed by the Circuit Court. 3. The following potential heirs are also placed upon notice: any heirs of the now deceased Joseph Jackson Thomas, Mary Erwin (who passed on or about 4/20/17), Franklin Persinger (who passed on or about 1/2/15), Charles Herman Persinger (who passed 10/17/2018). 4. Any claims of Amanda B. Sigmon-Bateman. 5. Any claims of Jo Tabor Floyd Sigman, Jr., Carol Shafer, John Sigman, Barbara Workman, the heirs of Phyllis Neal Phalen’s (namely Angela Akers, Thomas Neal, Jr., John Neal), Larry Sigman, Debbie Spaulding, and Mark Sigman). 6. Any claims of heirs of Ollie and RI Milbee against any of the above property. 7. Any one else who can assert a valid claim to any of the above described real estate other than the heirs already accounted for in 17 C-150 as set forth above. 8. To the extent you believe you may be entitled to a share of distribution from the partitioned sale of rear estate, and wherein you were not previously notified, you may make such claim for your percentage of heirship within 30 days of the first run of this publication by filing the same with the Clerk of the Circuit Court of Putnam County in 17 C-150 as well as serving a copy upon Steven T. The purpose of the the above notice is two fold, notice of the actual judicial sale of the property as well as addressing all claims so that the Court can transfer and vest good title to any property conveyed and later approved by the Court with the results of the Special Commissioners sale which is scheduled to occur on Friday, the 4th day of October, 2019, offer and sale at public auction at the hour of 10:00 a.m., at the south front door of the Putnam County Courthouse, Winfield, West Virginia.
