NOTICE IN THE CIRCUIT COURT OF CABELL COUNTY, WEST VIRGINIA Civil Action No.: 19-C-224 FIRST GUARANTEE MORTGAGE CORPORATION, Petitioner, V. ETHEL M. DAVIS, ROBERT H. SKEEN, JR., Trustee, Nominal Party, Respondent. ORDER OF PUBLICATION The object of the above entitled action is to reform by Order, pursuant to W.Va. R. Civ. P. 57 and W.Va. Code 55-13-1 et. seq., a certain Deed of Trust, which secures the first lien mortgage loan upon the Respondent’s real estate. Such real estate, which is the subject of this action was purported to be the home of the Respondent Davis. And it appearing by an affidavit filed in this action that personal service upon the Respondent Ethel M. Davis was attempted by the Cabell County Sheriff’s Department, without effect; the property was vacant; the Petitioner attempted serve at an alternative address, and that the Petition herein used due diligence to ascertain the whereabouts of the Respondent, without effect. And it appearing by an affidavit filed in this actin that personal service upon the Nominal Respondent Robert H. Skeen, Jr., was attempted by the Putnam County Sheriff’s Department, without effect, and that the Petitioner herein used due diligence to ascertain the whereabouts of the Respondent Skeen, without effect. It is hereby ORDERED that Ethel M. Davis and Robert H. Skeen, Jr., do serve upon Jeffrey Hood, Cabell County Circuit Clerk, whose address is 750 Fifth Avenue, Huntington, WV 25701, and Andrew F. Pahl, Attorney for Petition, 9920 Franklin Square Drive, Suite 100, Baltimore, MD 21236, an answer or other defense to the petition filed in this actin on or before Thirty (30) days from the date of first publication, otherwise judgment by default will be taken against Ethel M. Davis and Robert H. Skeen, Jr., at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at his office. Entered by the Clerk of said Court September 23, 2019.
