NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee, by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Cabell West Virginia, and by Deed of Trust dated December 16, 2011, executed by Joshua Kotalic to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2410 at Page 703, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on March 3, 2021 at Noon (registration to begin at 11:30 a.m.) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: Parcel One. All that certain lot, piece, or parcel of land situate in the City of Huntington, Cabell County, West Virginia, known and designated on the Revised Map of the City of Huntington made by L.W. Leete, Civil Engineer, which map was recorded in the office of the Clerk of the County Court of Cabell County, West Virginia, on the 31st day of December 1903 as a PORTION OF LOT EIGHT (8) in BLOCK 128, more particularly described as follows: BEGINNING at a point in the west line of 11th Street, 54 feet north of the intersection of the northerly line of 11th Avenue with the westerly line of 11th Street; thence from said beginning, northerly with the westerly line of 11th Street, 56 feet to a point; thence westerly, parallel to the north line of 11th Avenue, 60 feet to a point; thence southerly, parallel to 11th Street, 56 feet to a point-thence easterly, parallel to the north line of 11th Avenue, 60 feet to the point of BEGINNING. Parcel Two. All that certain lot, tract or parcel of land together with the improvements thereon and the appurtenances thereunto belonging situate in Huntington-Guyandotte District, Cabell County, West Virginia and being further described as follows: Being Lot Number Two (2) of Block Number Twenty (20) as set forth and shown on that certain map or plat entitled “Revised Map Cole & Crane Plat Altizer Place”, prepared by Joseph N. Doyle, Engineer, and recorded in the Office of the Clerk of the County Commission of Cabell County in Deed Book 180, at page 358. Parcel Three. All that certain lot or parcel of land, together with the buildings and improvements thereon, and the appurtenances thereunto belonging, situate in the City of Huntington, (that part of the City of Huntington formerly known as Central City), Cabell County, West Virginia, and being part of the Miller Sub-division of the said Central City, of Blocks Numbers Twenty-Three (23), Twenty-Four (24), Twenty-Five (25), and Twenty-Six (26), as shown on the map of said Central City made by George McKendree, Engineer, a copy of which map is filed in the aforesaid Clerk’s Office, on the 3rd day of October, 1891, and known and designated on a map of the said Miller Sub-Division, made by Leete and Maupin, Engineers, a copy of which map was also filed in the aforesaid Clerk’s Office, in Deed Book 68 at page 446, as LOT NUMBER FIVE (5), BLOCK TWENTY-FOUR (24). TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with balance due and payable within forty-five (45) days from the date of the Sale payable by certified check, cashier’s check or wired funds. In addition to the sales price, the Purchaser will be responsible for a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and due at time of sale payable to Joe Pyle Auction & Real Estate Services LLC to determine final aggregate contract price. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. Further subject to the redemption rights of the Internal Services as set forth in 26 U.S.C 7425. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
