NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in her by the certain Deed of Trust dated August 12, 2015, and recorded in the Office of the Clerk of County Commission of Cabell County, West Virginia in Book 2587, at page 550, Instrument No. 5862741, the Deed of Trust dated September 30, 2015, and recorded in the Office of the Clerk of County Commission of Cabell County, West Virginia in Book 2598, at page 356, Instrument No. 5873489, and modified pursuant to the terms of the Modification of Deed of Trust dated October 21, 2016, and recorded in Book 388, at page 124, Instrument No. 5911306, said Deeds of Trust and Modification of Deed of Trust did convey unto Patrick W. Bryan, Trustee(s), certain real property described in said Deeds of Trust and Modification of Deed of Trust, and the beneficiary has elected to appoint Suzanne Jett Trowbridge, as Substitute Trustee, by Substitution of Trustee dated January 14, 2021 and recorded in the aforesaid Clerk’s office in Book 406, at Page 366, Instrument No 6083122 and by Substitution of Trustee dated January 14, 2021 and recorded in the aforesaid Clerk’s office in Book 406, at Page 368, Instrument No. 6083123. Default has been made under the above-referenced Deeds of Trust and Modification of Deed of Trust, and the undersigned Substitute of Trustee, having been instructed in writing by Peoples Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue entrance of the Cabell County Courthouse in Huntington, West Virginia on: February 26, 2021 at 1:00 P.M. the following described real estate located in Kyle District, City of Huntington, Cabell County, West Virginia, and more particularly described as follows: All the certain lot, piece or parcel of ground situate in the City of Huntington, Kyle District, Cabell County, West Virginia, known and designated on a map of subdivision of Lots laid off by W.H. Pennybacker, Thomas H. Harvey and W.P. Holderby, a copy of which map is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia in Map Book No. 3, as Map No. 121 A, as LOTS NUMBERS FOUR (4), FIVE(5), SIX (6), SEVEN (7), EIGHT (8), NINE (9), SEVENTEEN (17), AND EIGHTEEN (18). At the time of the execution of said Deeds of Trust and Modification of Deed of Trust, said property was reported to have an address of: 145 W 3rd Avenue, Huntington, WV 25701 The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: The Successful bidder shall pay a Ten Percent (10%) nonrefundable down payment to the Trustee at the conclusion of the auction, in cash and/or certified funds, with the balance due and payable within 45 days of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deeds of Trust and Modification of Deed of Trust, the Substitute Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deeds of Trust and Modification of Deed Trust reserve the right to submit a bid for the property at such sale, which bid may be in the form of a credit bid.
