NOTICE OF SALE BY SPECIAL COMMISSIONER NOTICE OF SALE pursuant to an order of the Circuit Court of Kanawha County, West Virginia, entered April 27, 2018, in the case of Glen Beckett & Dorothy Marie Beckett v. Tyrone L. Pierce, Civil Action Number 16-C-1080, and Appointment of Special Commissioner, Marc J. Slotnick, Esquire, the undersigned special commissioner will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on: WEDNESDAY, MAY 19, 2021, AT 10:00 O’CLOCK A.M. All those certain lots, tracts or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Marmet, Kanawha County, West Virginia, and being more particularly bounded and described as follows: PARCEL 1 – 213 98th Street – Pt Lt 37×163 Being the same property conveyed unto Glen Beckett by Vera J. McCormick, Clerk of the County Commission of Kanawha County by deed dated April 10, 2013, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 2844, Page 352. PARCEL 2 – 219 98th Street – LT 59×136 Main Street Being the same property conveyed unto Glen Beckett by Vera J. McCormick, Clerk of the County Commission of Kanawha County by deed dated April 10, 2013, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 2844, Page 328. PARCEL 3 – 301 96th Street – LT 47 Morris Being the same property conveyed unto Glen Beckett by Vera J. McCormick, Clerk of the County Commission of Kanawha County by deed dated April 10, 2013, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 2844, Page 307. The sale shall be made subject to any and all easements, rights-of-way, exceptions, reservations, restrictions, covenants, conditions, leases, liens or encumbrances affecting title to the property and further to any state of facts that would be disclosed by or apparent upon an inspection or an accurate survey of the property described above; provided, however; that any such restriction, covenant or condition indicating a preference. limitation or discrimination based on race, color, religion, sex, marital status, ancestry, disability, handicap, familial status or national origin is hereby deleted to the extent such restriction, covenant or condition violates 42 USC 3604(c). The sale shall further be made subject to any accrued and unpaid ad valorem real property taxes upon the property. The Special Commissioner makes no representations or warranties as to the validity or priority of such liens, taxes, encumbrances and other matters, if any. The subject property will be sold in “AS IS” condition, and the special commissioners make no representations or warranties of any kind or character concerning the condition of the real estate to be conveyed. Property sold by boundary, not by acreage or area. TERMS OF SALE: 1. The sale is subject to confirmation by the Circuit Court of Kanawha County, West Virginia. 2. Said property will be offered by the commissioner to bring the highest bid. 3. Said property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 4. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2. 5. The Special Commissioner reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Special Commissioner. 6. The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 7. A nonrefundable deposit equal to ten percent of the total purchase price is payable on the day of sale, by certified or cashier’s check or other immediately available funds.
