NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 8, 2017, executed by Borrower, Christopher Ray Angel, to Mark Vieweg, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2691, at Page 68. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5747 Ohio River Road, Huntington, WV 25702. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 5, 2019, of record in the Clerk’s Office in Book 402, Page 443. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 14th day of October, 2021 10:30 a.m. All that certain lot, piece or parcel of land situate in Barboursville District, Cabell County, West Virginia, known and designated on the Map of Meadow Heights which Map is recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 141, at Page 352, as Lot No. 22 and a triangular parcel of ground Easterly therefrom, more particularly described as follows: Beginning at a point in the east right of way line of State Route #62 (right of way is 40 feet wide at this point), said point being the northeast corner of Meadows Heights; thence Southwesterly with east line of State Route #62 200 feet; thence Southeasterly at right angle to State Route #62 497.72 feet; thence Northeasterly N. 43 45′ E., 204.08 feet; thence Northwesterly at a right angle to State Route #62 457.75 feet to the point of beginning. EXCEPTING however from the above described property the northeasterly portion of Lot No. 22, and wedge-shaped piece of ground conveyed to Mary Martha Pancake by J. H. Wilson and Ethel M. Wilson, husband and wife, and Herman F. Shank, widower, by Deed dated January 30, 1942 and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 325, at Page 256, being more particularly described as follows: Beginning at a point in the south line of the Ohio River Paved Road, 10 feet Westerly from the northeast corner of said Lot No. 22, thence S. 34 57` E., 295 feet to a point; thence in an Easterly direction, parallel with the Ohio River Paved Road, 120 feet to a point; thence Northerly 34 57` W., 295 feet to the point in the south line of said Ohio River Paved Road; thence in a Westerly direction with the south line of said Paved Road, 120 feet to the point of beginning. Being the same property conveyed to Christopher Ray Angel by the Deed dated October 10, 2014 and recorded in Deed Book 1313 at Page 667 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
