PUBLIC NOTICE REGARDING AMENDMENT TO CITY’S WRITTEN PLAN UNDER THE MUNICIPAL HOME RULE PROGRAM HEREBY the City of Huntington, a participant in the Municipal Home Rule Program, is proposing amendments to the City’s existing approved written plan under the Municipal Home Rule Program, and will be holding a public hearing on the date and time herein described, to inform members of the public about the City’s proposed amendments to its written plan in accordance with W. Va. 8-5-1a(g). Prior to the public hearing referenced below, a copy of the written plan will be available for thirty (30) days for inspection by all members of the public at the Clerk’s Office in City Hall, located at 800 5th Avenue, Huntington, WV 25701. The City will thereafter present an Ordinance to Council, following two (2) readings, requesting approval to submit the amended written plan to the Municipal Home Rule Board. All details regarding the proposed amendments to the City’s written plan, the process for amending an already existing approved written plan, and the relevant timeline are provided below: Public Hearing: Day: Wednesday, March 2, 2022 Time: 8:30AM Location: City Hall Council Chambers Proposed Amendment to the Written Plan: 1. The City is seeking to establish a partial landlord-tenant relationship between Sober Living Home (“SLH”) operators and residents. Related thereto, the City’s amended written plan intends to circumvent operators ability to summarily evict residents by requiring operators provide residents with statutory and due process during evictions as prescribed in W.Va. Code 55-3-1 et seq., unless an enumerated exception applies. The exceptions noted are: (1) active drug and alcohol use; (2) violence against another resident; and/or (3) sexual activity with another resident. Process: Any qualified voter or any freeholder of the city may attend the public hearing held on the date and time herein described, and may vocalize objections to the City’s presented Ordinance, which would authorize the City to submit the proposed amended written plan to the Municipal Home Rule Board. The City will read the Ordinance for the first time at a council meeting held on March 14, 2022, starting at 7:30PM, which will take place in the City Council Chambers, located at Huntington City Hall, 800 Fifth Avenue, Huntington, West Virginia 25701. At the next council meeting, held on March 28, 2022, also taking place at the same location and time described above, the Ordinance will have its second reading and thereafter be submitted to Council for approval.
