IN THE CIRCUIT COURT OF MORGAN COUNTY, WEST VIRGINIA IN RE: PROCLAMATION OF ELECTION TO FILL UNEXPIRED TERM OF MAGISTRATE, DIVISION 2 OF THE MAGISTRATE COURT OF MORGAN COUNTY ORDER AND PROCLAMATION WHEREAS, Vince Shambaugh was appointed magistrate for Division 2 of the Magistrate Court of Morgan County, West Virginia, effective January 2, 2025, to fill the vacancy created by the resignation of Magistrate Elect K.C. Bohrer. WHEREAS, according to W.Va. Code §3-10-3(c), if the unexpired term be for a period of more than two years, the appointment shall continue until a successor is elected and certified in a subsequent election. WHEREAS, the chief judge shall cause a notice of such election to be published prior to such election as a Class II-0 legal advertisement in compliance with the provisions of W.Va. Code §59-3-1 et seq., pursuant to W.Va. Code §50-1-6. NOW, THEREFORE, the Honorable Debra McLaughlin, Chief Judge of the Twenty-Seventh Judicial Circuit does hereby PROCLAIM, that the unexpired term for the office of Magistrate, Division 2 of the Magistrate Court of Morgan County, West Virginia, be filled by the voters of Morgan County in the subsequent nonpartisan judicial election to be held concurrently with the Primary Election on May 12, 2026. Therefore, it is ORDERED that the Clerk of the Morgan County Commission place on the ballot for the nonpartisan judicial election to be held concurrently with the Primary Election on May 12, 2026, the unexpired term for the Office of Magistrate, Division 2 of the Magistrate Court of Morgan County, West Virginia. It is further ORDERED that the Clerk of the Morgan County Commission accept a certificate of announcement as required by West Virginia Code §3-5-7 and full payment of the filing fee, as set out by law, from any candidate seeking election to the unexpired term. It is further ORDERED that the Clerk of the Morgan County Commission shall cause this Proclamation to be published as a Class II-0 legal advertisement in The Morgan Messenger.
