NOTICE OF TRUSTEE SALE

Pursuant to the authority vested in the undersigned by Deed of Trust dated the 24th day of August, 2018, executed by Nathan S. Keffer and Chelsea M. Wilson, unto Harold B. Wolfe, III, Trustee, which said Deed of Trust is ofrecord in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1359 at Page 790, and the undersigned, Harold B. Wolfe, III, have been requested to do so by the beneficiary, and default having been made under the terms and conditions of said Deed of Trust, and the provision in said Deed of Trust and Note concerning acceleration having been compiled with by the beneficiary and present holder of the Note, said Trustee will sell at public auction at 10:00 a.m. on the 12th day of February, 2020, at the front doors of the Courthouse of Mercer County, West Virginia, the following described property, to-wit:

TRACT 1
a certain tract or parcel of real estate situate on the waters of Dave’s Fork of Brush Creek, approximately 1 mile northeast of Princeton, on Athens Rd., St. Rt. #20, East River District, Mercer Co. WV, which is more particularly bounded and described as follows:

Beginning at 5/8″ rebar with a cap in the northwestern right-of-way line of Athens Rd., St. Rt. #20, and in the common southern corner of Tract #1 & #2 of the Joe H. Peery heirs property (Tract #1 herein described); thence leaving northwestern right-of-way line of said St. Rt. #20, and running with the common line of said Tract #1, the following course and distance:

N40deg.44’41″W – 362.58′ to a 5/8″ rebar with a cap set

S46deg. 47′ 59″W – 177.85′ to a 5/8″ rebar with acap set in the common line of the Jerry R. & Judy V. Williams property; thence leaving the common corner of said Tract #2, and running partially with the common line of said Williams, then with the common lines of the Lisa D. Corner property and the Bonita Miano property (D.B. 768 Pg. 244), the following course and distance:

N43deg. 02′ 47″W – 234.78′ to a 1-1/2″ steel pipe with a mine roof bolt guard in the common corner of the now or former Sandra K. Korber property; thence leaving the common line of said Miano, and running with the common line of said Korber, the following course and distance:

N54deg. 16′ 23″E – 212.94′ to a 5/8″ rebar with a cap set at the base ofa steel rail and in the common line of the Trustees for Princeton Allegheny Wesleyan Methodist Church; thence leaving the common corner of the said Korber property, and running partially with the said Church property, then with the Nancy K. Whitlow property, the following course and distance:

S40deg. 44′ 41″E- 573.86′ to a 5/8″ rebar with a cap in the northwestern right-of-way line of said St. Rt. #20; thence leaving the common corner of said Whitlow, and running with the northwestern right-of-way line of said St. Rt. #20, the following chord bearing and distance:
S55deg.56’51″W-25.17′ to the point of beginning, and containing 1.26 acres more or less.

There is further granted and conveyed with above described tract, a blanket access, maintenance and utility easement over Tract #2 as shown on the attached hereto plat for any existing or future utilities and any other access that may be deemed necessary by the owner of said Tract #1, their heirs and assigns. This easement shall run with the land in perpetuity.

TRACT 2
A certain tract or parcel ofreal estate situate on the waters of Dave’s Fork of Brush Creek approximately 1 mile northeast of Princeton, on Athens Rd., St. Rt. #20, East River District, Mercer Co. WV, which is more particularly bounded and described as follows:

Beginning at 5/8″ rebar with a cap in the northwestern right-of-way line of Athens Rd., St. Rt. #20, and in the common southern corner of Tract #1 & #2 of the Joe H. Peery heirs property (Tract #2 herein described); thence leaving the common corner of said Tract #1, and running with the northwestern right-of-way line of said St. Rt. #20, the following chord bearing and distance:

S55deg. 56′ 51″W – 165.32′ to a 5/8″ rebar with a cap set in the common corner of the Kaylee’,s, LLC property; thence leaving the northwest right-of-way line of said St. Rt. #20, and running partially with the common line of said Kaylee’s, LLC, then with the common lines of the Norman & Joyce Shoda property and the Jerry R. & Judy Williams property, the following course and distance:

N43deg. 02′ 47″W – 335.96′ to a 5/8″ rebar with acap set in the common western corner of said Tract # 1; thence leaving the common line of said Williams, and running with the common line of said Tract #1, the following two (2) courses and distances:

N46deg. 47′ 59″E – 177.85′ to a 5/8″ rebar with a cap set

S40deg. 44′ 41’E – 362.58′ to the point of beginning, and containing 1.37 acres more or less.

There is excepted and reserved from the above described tract, for the benefit of said Tract #1 as shown on the attached hereto plat, a blanket access, maintenance and utility easement over the above described Tract #2 for any existing or future utilities and any other access that may be deemed necessary by the owner of said Tract #1, their heirs and assigns. This easement shall run with the land in perpetuity.

And also being the same property conveyed unto Nathan S. Keffer and Chelsea M. Wilson by deed dated August 8, 2018, recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 1069, at Page 350.

It is the intention of this Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

The above described real estate is reported to have a physical address at 1445 Athens Road, Princeton, Mercer County, West Virginia, 24740.

This sale will also be made subject to any and easements heretofore granted by predecessors in title; and subject further to any and all unpaid real property taxes and unpaid assessments, the purchaser assuming payment thereof.

The owners and holders of said Note reserving the right to enter a bid at said sale and the right to reject any and all bids.

The Trustee reserves the right to reject any and all bids.

TERMS OF SALE: Cash in hand on the day of sale, or upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title to this property.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a Notice of same where legal notices are posted for this county.

Should the Trustee not appear at the time appointed for the sale and there is no Notice posted of a continuance, please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated gent to sell said property as Trustee by instrument to be recorded.
