The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated April 15, 2005, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed of Trust Book 1039, at Page 767, Kerrie A. Williams did convey unto Richard A. Pill, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse, in Princeton, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the East River District, Mercer County, West Virginia, and more particularly described as follows:

“All of those certain lots or parcels of land known as Lot 57 and the southern half of Lot 58, City View Heights, as more fully shown on a map entitled ‘PLAT OF SURVEY SHOWING THE EVERA LEON & JUDY LILLY LOT AS DESCRIBED IN DEED BOOK 455 AT PAGE 386 WHICH IS SITUATE JUST SOUTH OF PRINCETON IN CITY VIEW HEIGHTS, EAST RIVER DISTRICT, MERCER COUNTY, WEST VIRGINIA DANA PETTREY & ASSOCIATES P.O. BOX 641 ATHENS, WEST VIRGINIA Date: 3/17/83 Scale: 1″=30′”, said plat recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 8350, and more fully bounded and described as follows:

“BEGINNING at an iron pin found in the eastern right-of-way line of Kirkwood Avenue, also being the northwestern corner of the Roy Farris lot; thence with the eastern right-of-way line of Kirkwood Avenue, N. 15 deg. 15′ W. 75.0 feet to an iron pin found, being the southwestern corner of Johnny Vipperman’s lot; thence with the dividing line of Vipperman’s lot and the property herein described, N. 74 deg. 45′ E. 150.0 feet to an iron pin found in the western line of Jessie Burks’ lot; thence with the western line of Burks’ lot and continuing with Robert Anderson’s lot, S. 15 deg. 15′ E. 75.0 feet to an iron pin found, being the northeastern corner of Roy Farris’ lot; thence with the dividing line of Farris’ lot and the property herein described, S. 74 deg. 45′ W. 150.00 feet to the place of BEGINNING.”

“This conveyance is subject to all restrictions, easements and reservations set forth in prior deeds.”

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 322 Kirkwood Avenue, Princeton, WV 24740.

AND BEING the same real estate which was conveyed to Kerrie A. Williams by deed dated April 15, 2005, from Doreen Christian, Executrix of the Estate of Geneva Christian, and recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 880, at Page 669.
The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
