TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 23, 2009, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book No. 1162, at Page 606, Brittney Rochester and Darrell Southern did convey unto John Shott, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 23, 2015; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on April 30, 2015 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and more particularly described as follows: “That certain parcel of land as shown upon the map bearing the legend “PLAT SHOWING A 0.2 ACRE PARCEL OF LAND LYING ON THE WATERS OF BRUSH CREEK OF BLUESTONE RIVER BEAVER POND DISTRICT MERCER COUNTY BEING SITUATE AT THE COMMUNITY OF MAP ACRES WEST VIRGINIA SCALE 1″=15′ AUGUST 20, 1998 /s/ A.M. SHIELDS, III”, said plat recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 13771, and more particularly described as follows: “Beginning at a 1/2″ Rebar set in the northeastern right-of-way of Mercer County Route Number 19/33 and in the southwestern line of Roger and Joyce Prevento; thence the lands of said Prevento the following two calls N 61?- 41′ -35 E. 100.00′ to a 1/2″ rebar set; thence N 22?-30′-35″E 50.30′ to a 1/2″ rebar set in the northwestern line of Jimmie and Nedra Thompson; thence with the common lines of said Prevento and said Thompson the following two calls S 47?-41′-40″W 13.72′ to a 1/2″ Rebar set; thence S 24?-39′-00″E 46.22′ to a 1/2″ Rebar set in the southwestern line of said Thompson and in the northeastern line of said Prevento; thence through the lands of said Prevento and passing through a _” Rebar set at 16.18′ then continuing on said line for 72.58′ for a total bearing and distance of S 61?-41′-35″W 88.76′ to a 1/2″ Rebar found in the northeastern line of said Court Route; thence with the right-of-way of said County Route N. 22?-30′-35″W 100.00 to the point of beginning and contain 0.22 acres, more or less.” This conveyance is also subject to all easements, reservations and rights of way record. There is hereby reserved a 16.15 ft. wide easement as shown upon the above referred to map from this conveyance which said easement is located on the eastern side of said lot as shown upon the above referred to map and is for the purpose of utility poles and lines.” This conveyance is made subject to all unpaid real estate taxes and assessments due on the said land, if any, and to all covenants, easements and other matters appearing of record in the aforesaid Clerk’s Office. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2175 Maple Acres Road, Princeton, WV 24740. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
