NOTICE OF TRUSTEE’S SALE Notice is hereby given that the undersigned, David H. Wilmoth, Substitute Trustee under that certain deed of trust executed by Tokita Webb, dated July 21, 2005, securing Federation of Appalachian Housing Enterprises, Inc., of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1049 at page 679, and default having been made by Borrower, and lender having requested in writing the undersigned Substitute Trustee will offer for sale at public auction to the highest responsible bidder, at the front door of the Mercer County Courthouse, Princeton, West Virginia, on the 16th day of January, 2015, at 1:30 p.m., the following lot or parcel of real estate situate in the Town of Bluefield, Mercer County, West Virginia, as shown upon a map entitled “Map Showing Division of Lots 6 & 7 Sect. 1602 Marellen St. & Bluemont Dr. Bluefield, Mercer Co., WV” by Appalachian Engineering & Surveying, Inc. Dated January 6, 2004, rev. February 2, 2004, and of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Microplat #15211, and being more particularly bounded and described as follows: “BEGINNING at a roof bolt in the western right-of-way line of Bluemont Drive, said bolt being the southeastern corner of Lot 5 and the northeast corner of Lot 6 and the herein described tract; thence along said right-of-way S 26? 04′ E 57.92 ft. to a point; thence leaving said right-of-way and through the east part of Lot 7 with a new property line S 70? 51′ W 166.29 ft. to a point; thence trough Lots 6 and 7 with a new property line N 19? 09′ W 57.50 ft. to a rebar; thence along the southern line of Lot 5 N 70? 51′ E 159.32 ft. to the point of BEGINNING and containing 9,361 sq. ft.” Being the same real estate conveyed to Tokita Webb by Community Action of South Eastern West Virginia, Inc., by deed dated July 21, 2005, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 884 at page 375. Said sale will be “as is” and will be without covenant or warranty and will be subject to all existing reservations, restrictions, exceptions, conditions, easements, rights of way or other servitudes, if any, made, retained or created in prior deeds of record in the chain of title to the property herein described. The undersigned reserves the right to reject any and all bids and to continue the sale of the real estate from time to time by announcement made at the time of the sale or any continuance thereof.
