NOTICE OF TRUSTEE’S SALE

To: Scott A. Blaney

Notice is hereby given that pursuant to the authority of that certain Deed of Trust executed by Scott A. Blaney, to the Trustee as therein named for said Lender, said Deed of Trust bearing date of the 27th day of December, 2005, and of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Trust Deed Book No. 1438, at Page 644, and default having been made in the payment of the indebtedness secured by the aforesaid Deed of Trust, and further, said Lender having executed that certain Appointment of Substitute Trustee appointing and substituting Keith J. Pappas as the Trustee of the aforereferenced Deed of Trust instrument, and that the said Trustee has been formally instructed by said Lender, the owner and holder of the Note evidencing said indebtedness, to advertise and sell the property as hereinafter described, on the terms and provisions as more particularly set forth in said Deed of Trust. Therefore, I, Keith J. Pappas, the undersigned Trustee, will on Wednesday, the 8th day of July, 2015, at 11:00 a.m., offer for public sale to the highest bidder, for cash, at the main entrance of the Monongalia County Courthouse, situate at 243 High Street, Morgantown, West Virginia, the real estate as conveyed by said Deed of Trust and therein described as follows, to wit:

All those certain parcels of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Morgan, District, Monongalia County, West Virginia, with a known address of 239 McKinney Cave Road, Morgantown, West Virginia, more particularly bounded and described as follows:

Beginning at an axle and 2 inch iron rod located at a common three way corner, said point being referenced as South 12° 15′ 00" East 100 feet from a 1 inch iron rod monument described as the northeastern corner of the adjoining 1.01 acre tract, said beginning point also being further identified as the original northeastern corner of the 2.169 acre tract and Tract "A"; thence running with the original line of the 2.169 acre tract and also with the adjoining common western line of a 73.64 acres tract, South 12° 15′ East 340.70 feet to a 5/8 inch rebar located on the northern right of way line of West Virginia Route No. 72/3, said point being referenced as North 12° 15′ 00" West 2.47 feet from an axle; thence running with the adjoining northern right of way of West Virginia Route No. 72/3, North 65° 16′ 11" West 150.30 feet to a 5/8 inch rebar; thence North 61° 00′ 41" West 121.74 feet to a 5/8 inch rebar; thence leaving the right of way line of West Virginia Route No. 72/3 and running with a new division line through the original 2.169 acre tract, North 16° 07′ 55" East 212.39 feet to a 5/8 inch rebar located in the original northern line of the tract, said point being further referenced as North 86° 25′ 00" East 328 feet from a 1 inch iron rod; thence running with that original northern line and also with the adjoining common southern line of 1.01 acre tract, North 86° 25′ 00" East 112 feet to the place of beginning, containing 47,917 square feet or 1.100 acres, more or less, as is shown on a plat recorded in Deed Book No. 1206, at page 220.

And being the same parcel of real estate conveyed to Scott Blaney and Robin Blaney by Deed from Page A. Blaney and Melvina L. Blaney, dated the 10th day of October, 2000, recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book No. 1206, at page 218. Thereafter, the said Robin Blaney conveyed her undivided one-half (1/2) interest in and to the aforesaid parcel of real estate to Scott Blaney by Deed dated the 27th day of December, 2005, recorded in the aforesaid Clerk’s Office in Deed Book 1310, at page 63.

THIS SALE is made subject to any prior liens, assessments or mortgages, persons in possession and the rights of any tenants therein and said property is being sold "as is," and "where as," without any representation or warranty, express or implied, as to the condition of the improvements, the availability of utilities, whether latent or patent defects may exist therein or thereon, the existence of any defect respecting the quality or marketability of the title thereof, matters which would be revealed by an accurate survey or visual inspection of the premises, the improvements thereon and its boundaries.

TERMS OF SALE: Said real estate will be sold for cash in hand on the day of the sale or other terms as may be acceptable to Lender on said day and date. All persons intending to be present at said time and place of sale, and intending to bid, must register with Trustee, showing a valid proof of identity and letter of credit from source of funds or bank in amounts equivalent to any proposed bid, plus costs.
