NOTICE VIRGINIA: IN THE CLERK’S OFFICE OF THE CIRCUIT COURT OF THE COUNTY OF TAZEWELL, VIRGINIA, THIS 8 DAY OF JULY, 2015. PATRICIA ANN LANE POE, INDIVIDUALLY, AND AS EXECUTRIX UNDER THE LAST WILL AND TESTAMENT OF ROSA NELL LAMBERT LANE, DECEASED, ET AL, PLAINTIFFS VS. CHARLES EUGENE GREENE, ET AL, DEFENDANTS CASE NO: CL15-773 ORDER OF PUBLICATION The object of this suit is to remove a cloud on title to Lots Twelve (12) and Thirteen (13) of the Subdivision of the Gus Payne Land in Baptist Valley, Tazewell County, Virginia, formerly owned by Cecil Lane and Rosa Nell Lambert Lane, both deceased, which cloud on title is presented by an outstanding one-half interest of record in said Lots, the interest having been originally obtained by Betty Caudill by deed dated August 7 1946 and of record in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 169, page 572, by finding and adjudging that Bette Manning Caudill Todd Greene (same individual as Betty Caudill), while alive, or her heirs, devisees or successors after her death, have lost said interest by adverse possession for the prescribed period, being in excess of fifteen (15) years, to Cecil Lane and Rosa Nell Lambert Lane, parents of the Plaintiffs, and to the Plaintiffs, as their successors, and that title to said undivided one-half interest be perfected in either the Plaintiffs, individually, or in the Plaintiff, Patricia Ann Lane Poe, as Executrix under the Last Will and Testament, of Rosa Nell Lambert Lane, deceased And, an Affidavit has been make and filed that the following heir and successor to Betty Manning Caudill Todd Greene, defendant, is a non-resident of the Commonwealth of Virginia and has the following last-known post office address: CHARLES EUGENE GREENE Palmerston North, New Zealand And, an Affidavit having further been made and filed that certain defendants, as heirs, devisees or successors of Charles Eugene Greene, if he be deceased, and unknown heirs, devisees or successors of Bette Manning Caudill Todd Greene, If any there be, may have an interest in said property as such and are unknown as follows: unknown heirs, devisees or successors of Charles Eugene Greene, if he be deceased, unknown heirs, devisees or successors of Bette Manning Caudill Todd Greene, deceased, if any there be, and all other parties unknown that may have an interest in the subject property and who are proceeded against generally as all other parties unknown. It is ORDERED that the aforesaid defendants appear on or before the 28 day of August, 2015, in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia and do what is necessary to protect their interests. It is further ORDERED that the foregoing portion of this Order be published in the Bluefield Daily Telegraph, a newspaper of general circulation in Tazewell County, Virginia, for four successive weeks, that a copy be posted at the front door of the courthouse of Tazewell County, Virginia, and also al copy of such Order be mailed to the foregoing defendants at their last-known post office addresses given in the Affidavit herein, all to be done within ten (10) days after the entry of this Order.
