The object of the above entitled action is to determine the rights of the Defendants as to surplus funds relating to the foreclosure on the property located at 532 Milford Street, Morgantown, Monongalia County, West Virginia, with a Deed of Trust of record in Trust Deed Book 1816, at page 391.
And it appearing by that the identity and whereabouts of Defendant, Benjamin M. Riffle, is unknown and cannot be located after due diligence, it is ORDERED that the above named Defendant serve upon Plaintiffs attorney W. Scott Campbell or Patrick D. Johnson and the law firm of Samuel I. White, P.C., whose mailing address is 601 Morris Street, Suite 400, Charleston, WV 25301, an answer or any defense to the Complaint for Interpleader filed in this 6 action on or before July 30, 2015; otherwise judgment by default may be taken against said Defendants at any time thereafter. A copy of the Complaint for Interpleader in this action may be obtained from the undersigned Clerk’s office.
