NOTICE OF TRUSTEE’S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Jeff Heaster and Bonnie Heaster, to C. Patrick Harris and J. Chris Haddox, Trustee(s) dated January 9, 2004, and recorded in the office of the Clerk of the County Commission of Monongalia County, West Virginia, in Trust Deed Book 1271, at page 180, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated May 8, 2015, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on August 20, 2015 at 11:20 a.m., at the front door of the courthouse of Monongalia County, West Virginia, the real estate conveyed by said deed of trust and situate in Union District, Monongalia County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 624 Snake Hill Road, Morgantown, West Virginia and being more particularly bounded and described therein as follows:
ALL of LOT DTH "B", which is more particularly bounded and described as follows:

BEGINNING at a point standing in the centerline of West Virginia State Route 75/2 (commonly called Snake Hill Road – having a 40 foot right-of-way width or Morgantown & Independence Turnpike – having a 60 foot right-of-way width) and marking the northernmost corner to a parcel conveyed to William H. and Helen M. Hagerty by deed recorded in Deed Book 1077, at Page 360; thence with said Hagerty parcel, S. 51 ° 20′ 20" W. (said lines passes through a 1/2 inch reinforcing rod (found) standing at a distance of 20.00 feet) 611.53 feet in all to a 1/2 inch reinforcing rod (found), said rod marking a common corner to said Hagerty parcel and Units Nos. 8 and 9 of the Mountain Village Development (see plat of said Development recorded in Map Cabinet No.3, at File 49B); thence with said Unit No. 8, N. 48° 10′ 20" W. 115.57 feet to a 1/2 inch reinforcing rod (set), said rod marking the southernmost corner to Lot DTH "A"; thence with said Lot DTH "A", N. 36° 56′ 40" E. (said line passes through a 1/2 inch reinforcing rod (found) standing at a distance of 345.90 feet) 377.42 feet in all to a point, said point standing in the centerline of said Route 75/2; thence with three (3) lines marking the centerline of Route 75/2, S. 85° 01′ 00" E. 62.70 feet to a point; thence N. 86° 37′ 40" E. 156.06 feet to a point; thence S. 89° 47′ 40" E. 118.53 feet to the beginning, containing 84,829 square feet or 1.9474 acres, more or less, as shown on a plat of survey prepared by Allan J. Witschi, P S. No. 587, of Greenleaf Surveying Company, recorded in Map Cabinet No.3, Envelope 49-B.

And being the same real estate which was conveyed to Mon County Habitat for Humanity, Inc., by deed of Dale T. Heaster dated May 5, 2003, and recorded in the office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1252, at Page 486.

Said property having street address of 624 Snake Hill Road, Morgantown, WV 26508.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an "AS IS" condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The Monongalia County Habitat for Humanity Incorporated or the West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Cash in hand on day of sale.
