NOTICE OF TRUSTEE SALE Pursuant to the authority vested in the undersigned by Deed of Trust dated the 1st day of July, 2005, executed by Oliver R. Lewis, Sr., and Bonnie J. Lewis, unto Harold B. Wolfe, III, Substitute Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1047 at 702, and the undersigned, Harold B. Wolfe, III, has been requested to do so by the beneficiary, and default having been made under the terms and conditions of said Deed of Trust, and the provision in said Deed of Trusts concerning acceleration having been compiled with by the beneficiary and present holder of the Note, said Trustee will sell at public auction at 10:00 a.m. on the 12th day of November, 2015, at the front doors of the Courthouse of Mercer County, West Virginia, the following described property, to-wit: All that certain tract of parcel or real estate known as Lot 12 Lilly Acres, Beaver Pond District, Mercer County, West Virginia, as shown upon a Map entitled “MAP SHOWING PARCEL 160, TAX MAP 10, BEING LOT 12 LILLY ACRES LORTON’S LICK ROAD BEAVER POND DIST., MERCER CO., WV JOB NO. 97290 SCALE: 1″ = 30′ DATE: 8/4/97 DRAW BY: JSL REVISIONS; CK’D BY: JWL, APPALACillAN ENGINEERING & SURVEYING, INC. 212 COLLEGE AVE. -BLUEFIELD WV 24701 PHONE 304-325-3481, which map is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat No. 12920, and which said property is more particularly bounded and described as follows: BEGINNING at a railway spike (found) in a driveway near Lorton Lick Road, a common comer with Bernard C. Wright; thence N. 69? 39′ W. 68.00 ft. to a roof bolt (set); thence S. 85? 57′ 32” E. 30.75 ft. to an iron bar (set); thence S. 31? 57′ E. 71.90 ft. to an iron bar (set); thence S. 27? 22′ E. 113.00 ft. to an iron bar (set); thence S. 23? 21′ E. 267.10 ft. to an iron bar (set); thence S. 66? 00′ W. 33.78 ft. to a rebar (found); thence N. 33? 06′ W. 473.47 ft. to ang “x” on a rock on line (found); thence N. 33? 06′ W. 139.59 ft. to the place of BEGINNING containing 0.75 acres more or less. And being the same real estate conveyed unto Oliver R. Lewis and Bonnie J. Lewis from Jesse R. Cook, Jr., and Tina M. Cook by deed dated the 1st day of July, 2005, of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 883 at Page 637. And being the same property is made subject to any exceptions, reservations, covenants and conditions as may be contained in the chain of title to said real estate. It is the intention of this Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust. The above described real estate is reported to have a physical address at 669 Lorton Lick Road, Bluefield, Mercer County, West Virginia, 24701. This sale will also be made subject to any and easements heretofore granted by predecessors in title; and subject further to any and all unpaid real property taxes and unpaid assessments, the purchaser assuming payment thereof. The owners and holders of said Note reserving the right to enter a bid at said sale and the right to reject any and all bids. The Trustee reserves the right to reject any and all bids. TERMS OF SALE: Cash in hand on the day of sale, or upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title to this property. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a Notice of same where legal notices are posted for this county.
