NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated February 23, 2004, executed by Borrower(s), Lorrie Proffitt- Ellison, to Shott, Gurganus, Williamson and Magann, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1000, at Page 436 and rerecorded in Book 1044 at page 173. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1100 Thornton Avenue, Princeton, WV 24740. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 12, 2015, of record in the Clerk’s Office in Book 1305, Page 772. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date: December 17th, 2015 at 12:02 P.M. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in East River District, Mercer County, West Virginia, and being more particularly described as follows: All that certain lot or parcel of land situate in East River District, Mercer County, West Virginia, known and designated as Lot No. 123 of the Lilly Grove Addition to the City of Princeton, Mercer County, West Virginia, as shown on a map entitled “Map Showing Part Parcel 87 Tax Map 8R Thornton Ave. & Gayle Street Lilly Grove Add. East River District, Mercer Co., West Virginia” by Appalachian Engineering & Surveying, Inc. Dated 10/15/03, and more particularly bounded and described as follows: BEGINNING at a roof bolt in the eastern right-of-way line of Gayle Street, said bolt being the northwest corner of Parcel 88 (lot 124) and also being the southwest corner of Parcel 87 and the herein described tract; thence along said right-of-way line for the next two calls: N 11? 45′ 00″ W 113.50 ft. to a point; N 23? 46′ 00″ E 19.05 ft. to a point in the southern right-of-way line of Thornton Avenue; thence along said right-of-way for the next two calls: N 69? 31′ 00″ E 51.55 ft. to a point; N 54? 10′ 00″ E 41.26 ft. to a roof bolt; thence leaving said right-of-way and through Parcel 87 (Lot 123) with a new property line S 26? 51′ 48″ E 159.17 ft. to a roof bolt; thence along the northern line of Parcel 86 (Lot 124) S 78? 15′ 00″ E 141.19 ft. to the point of BEGINNING and containing 16,774.29 sq. ft. or 0.38 acre more or less. And being the same property conveyed to the Grantor by deed of MANUEL WAYNE BROWN and ROSA E. BROWN, dated February 23, 2004 and intended to be recorded simultaneous herewith. Being the same property conveyed to Lorrie Proffitt Ellison by the Deed dated February 23, 2004 and recorded in Deed Book 866 at Page 614 in the Office of the Clerk of the County Commission of Mercer County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ? 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
