NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE`S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated August 11, 2005, executed by Borrowers, Steven A. Sommers and Kathleen E. Sommers, to Philip Hereford the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1052, at Page 162. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 34 Sharps Turn Rd, Princeton, WV 24740. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 12, 2014, of record in the Clerk`s Office in Book 1271, at Page 334. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date: February 12, 2015 at 11:30 a.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Rock District, Mercer County, West Virginia, and being more particularly described as follows: STEVEN A. SOMMERS and KATHLEEN E. SOMMERS “all that certain tract or parcel of real estate designated as Tract 2 of the Black Oak Heights Subdivision and shown on ‘MAP SHOWING PARCEL 49.1 TAX MAP 40 BLACK OAK HEIGHTS SUBD. Looney, Jr.’ prepared by Appalachian Engineering & Surveying, Inc., which map is of record in the Mercer County Clerk’s Office as Microfilm Plat No. 12706”, and more particularly bounded and described as follows: “BEGINNING at a point in the northern line of Sunset Drive as shown on said map, said point being the southwestern corner of Tract 2 and the southeastern corner of Tract 1; thence with the dividing line between said Tracts 1 and 2, N. 36? 30′ W. 2,120.00 feet to a point; thence S. 63? 47′ E. 101.08 feet to a point; thence S. 36? 30′ E. 2,112.41 feet to a point in said Sunset Drive; thence along the northern edge of Sunset Drive, N. 59? 30′ W. 100.00 feet to the point of the BEGINNING, and containing 4.83 acres, more or less.” And being the same property conveyed to Steven A. Sommers and Kathleen E. Sommers, husband and wife, by Thomas J. Goodwin and Catherine M. Goodwin, husband and wife, by Deed dated July 20, 2005, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, simultaneously with this instrument. “This conveyance is subject to all pertinent easements, restrictions, and reservations of record .” Being the same property conveyed to Steven A. Sommers and Kathleen E. Sommers by the Deed dated July 20, 2005 and recorded in Deed Book 885 at Page 251 in the Office of the Clerk of the County Commission of Mercer County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ? 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
