NOTICE OF TRUSTEE’S SALE OF REAL ESTATE The undersigned, Douglas E. Hayes, Trustee, by virtue of the authority vested in him under a certain Deed of Trust bearing date the 1st day of December, 2014, and of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1287, at page 647, executed by Charlotte L. Chambers, the Note therein secured being in default, and at the request of Billy M. Lovett, the holder and owner of said Note, will on the 6th day of July, 2016, at 9:30 a.m., at the Front Door of the Mercer County Courthouse (being the door on the North Walker Street side of said Courthouse), Princeton, West Virginia, offer for sale at public auction to the highest bidder, all of the following described real estate, with its appurtenances and improvements situate in the City of Bluefield, Mercer County, West Virginia, known as the Roten property, and being more particularly bound and described as follows, to-wit: “all that certain lot or parcel of land, with the improvements thereon and appurtenances thereunto belonging, situate and being in the City of Bluefield, Mercer County, West Virginia, known as the Roten Property, and being more particularly bound and described as follows, to-wit. “BEGINNING at a point on the east side of a 12 feet wide alley, leading northwest from Genoa Avenue, N. 49? W. 86.5 feet from the west side of Genoa Avenue, said point being the intersection of the east side of said alley, with the northwest side of Shepherd Alley; thence with the east side of said 12 feet wide alley, N. 49? W. 50 feet, more or less, to the corner of the James Anderson property; thence with the line of the Anderson property, N. 61? 45′ E. 74.5 feet, more or less, to a corner of the Adam Branch property; thence with the line of the Adam Branch property, S. 32? 15′ E. 45.5 feet, more or less, to the northwest side of the Shepherd Alley; thence with the northwest side of Shepherd Alley, S. 61? W. 61.4 feet to the point of BEGINNING.” At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 110 Nassau Court, Bluefield, West Virginia 24701. The above-referenced real estate will be conveyed with no covenants of warranty and subject to all leases, covenants, restrictions, easements, rights-of-way, and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances including, without limitation, liens for real estate taxes, sanitary and sewer charges. IN THE EVENT THERE ARE FEDERAL TAX LIENS AGAINST THE PROPERTY, THE UNITED STATES WOULD HAVE THE RIGHT TO REDEEM THE PROPERTY WITHIN THE PERIOD OF 120 DAYS FROM THE DATE OF SUCH SALE OR THE PERIOD ALLOWABLE FOR REDEMPTION UNDER LOCAL LAW, WHICHEVER IS LONGER. The terms of the Sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to the Trustee and the holder of the Note). Said real estate will be sold by said Trustee in “as is” condition, subject to all taxes now due or to become due on said property, all liens, restrictions, easements, rights of way, out conveyances, or other matters of record in said Clerk’s Office, affecting the title to said property. The Purchaser is to pay the excise tax on the privilege of transferring said real estate. The Trustee reserves the right to continue the Sale or to adjourn same for a time, or from time to time, without further Notice by announcement at the time and place of said Sale hereinabove set forth. THE PURCHASER, UPON PAYMENT OF THE PURCHASE PRICE IN FULL, SHALL RECEIVE FROM THE HEREINABOVE NAMED TRUSTEE, A DEED CONVEYING THE HEREINABOVE DESCRIBED PROPERTY, WITHOUT ANY COVENANT OR WARRANTY, EITHER EXPRESS OR IMPLIED, AND SUBJECT TO THE MATTERS HEREINABOVE MENTIONED. Notice is also given that any personal property and/or belongings remaining at the property afer the Foreclosure Sale will be deemed to constitute abandoned property and will be disposed of accordingly.
