NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 7th day of January 2011, signed by Alex H. Cline, Jr. and Cheryl R. Cline, husband and wife, to William Winfrey, II, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1204, at page 673, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 8:45 o’clock A.M. on the 4th day of FEBRUARY 2015 at the front doors of the Courthouse in Mercer County in Princeton, West Virginia the following described real estate: All of that certain tract or parcel of real estate designated as Lot 3A on “PLAT OF SURVEY SHOWING THE DIVISION OF PART OF THE MICHAEL D. & SIBLE JANE HALL PROPERTY, BEING A PART OF THE PROPERTY DESCRIBED IN D.B. 850 PG. 106, SITUATE ON THE WATERS OF WHITE OAK CREEK OF THE BLUESTONE RIVER, ON HORTON LANE, CO. RD. #3/6, PLYMOUTH DIST., MERCER CO., WV., SCALE 1″ = 200′, SURVEYED 6-05 BY RONALD D. FINK P.S. RT. 9 BOX 71B, PRINCETON, WV 24740″, said map recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Microfilm Plat No. 15549″, and more particularly bounded and described as follows: BEGINNING at a point in the line of Lot 1A, a common corner with Lot 2A; thence N. 64 degrees 33′ 48” W., 545.22 feet to an “x” cut on edge of cliff found; thence S. 12 degrees 42″ 03′ E. 452.77 feet to an “x” cut on edge cliff found; thence with the common line of Lot 4A, S. 69 degrees 28′ 11″ W. 398.13 feet to a point; thence N. 55 degrees 47′ 11″ W. 174.05 feet to a point; thence N. 16 degrees 46′ 36″ W. 260.35 feet to the place of BEGINNING, and containing 4.93 acres, more or less”. There is expressly excepted and reserved from this conveyance and this property is benefitted by a 30 foot wide easement as shown upon said plat to be utilized by the parties hereto and the owners of the lots served by said easement and their heirs and assigns.” This conveyance is made expressly subject to all pertinent restrictions, reservations, and easements of record. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 1572 Horton Lane, Princeton, West Virginia 24740 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
