The object of the above-entitled action is forfeiture. It appearing by a Petition filed in the above-styled action that the above-styled action that the Morgantown Police Dept. is responsible for the seizure on March 18, 2016 from the persons/vehicle of Markeith Stallworth and Shadrick Crowder in Monongalia County, WV.

It is ORDERED that any claimant shall serve upon the State of West Virginia, Perri DeChristopher, Petitioner’s Attorney, whose address is Monongalia County Prosecuting Attorney’s Office, 243 High Street, Morgantown, WV 26505, an answer other defense to the Petition filed in the above-styled action within thirty (30) days of the date of service of the Petition or within thirty (30) days of the publication, otherwise, judgment by default will be taken against the property at anytime thereafter. A copy of the Petition can be obtained from the undersigned Clerk at her office.

You have the right to file an Answer to the Petition setting forth your right to possession of the property within thirty (30) days from the service hereof. If you fail to file an Answer, a Final Order forfeiting the property to the State will be entered, and such Order is not subject to appeal.

FURTHER NOTICE

TO ANY OTHER CLAIMANT OF THE PROPERTY DESCRIBED WITHIN THE PETITION:

Any other person having a putative claim to the above-referenced property shall clearly state his or her identity and an address where legal process can be served upon him or her. Any such person shall refer to the specific Petition to determine a description of the seized property, the agency responsible for the seizure, the time and place of the seizure, the identity of the person in possession of the property at the time of seizure. The State has requested an Order directing forfeiture of the property to the State, investing ownership of the property in the State.

CIVIL ACTION NO. 16-C-175-DS NOTICE OF FILING OF PETITION FOR FORFEITURE The object of this suit is to seek an order forfeiting the herein described property pursuant to the West Virginia Contraband Forfeiture Act, Chapter 60A, Article 7, Section 701 through 707, et. seq., as amended. To: Any claimant of a right or interest in said property You have the right to file a claim to the herein described property on or before the 9th day of September, 2016 at 9:30 a.m. before the Honorable Judge Derek C. Swope. Any such claim must clearly state the identity of the claimant and an address where legal process can be served upon said claimant. The property seized and subject of this suit is described as follows THREE THOUSAND, ONE HUNDRED AND NINETY-FOUR DOLLARS AND 00/XX CENTS; A SAMSUNG CELLPHONE AND TWO LG CELL PHONES AND A SMITH AND WESSON .38 SPECIAL FIREARM. The law enforcement agency responsible for the seizure is the West Virginia Southern Regional Drug and Violent Crime Task Force. The seizure was made on April 28, 2016 during a search of the residence located at 309 Rogers Street, Bluefield, WV 24701. That the above listed respondent property was in the possession of Marvin Gillespie and Everett Gillespie. That after the date for filing of said claims, an order of the Court directing forfeiture of the seized property to the State and vesting ownership of said property shall be sought. If you fail to file a claim, thereafter an order, upon proper herein, may be entered against you for the relief demanded in the petition.
