NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 3rd day of June 2005, signed by Dana McIntyre and Rosemary McIntyre, husband and wife as joint tenants with rights of survivorship, to B. Nazelrod, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Trust Deed Book 1388, at page 139, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 10:15 o’ clock A.M. on the

19th day of FEBRUARY 2015

at the front doors of the Courthouse in Monongalia County in Morgantown, West Virginia the following described real estate:

The following described parcel of real estate situate, lying and being in Morgan District, Monongalia County, West Virginia, and being more particularly bounded and described as follows; to wit;

Beginning at an iron pin set on the boundary line of Elmer C. Murray property and property owned by John Bihun, thence along a certain right of way S. 65° 40′ W. 150.00 feet to an iron pin set; thence N. 39° 30′ W. 150.00 feet to an iron pin set; thence N. 65" 25′ E. 150.00 to an iron pin set; thence S. 39" 26′ 12 E. 3. 150.62 feet to the place of beginning, containing 0.50 acre, more or less, as more fully shown on a plat dated January 13, 1988, prepared by Duffer & Thompson, a copy of which is attached to this deed for a more particular description of the real estate hereby conveyed; and being part of the same real estate conveyed to Elmer C. Murray by George Thomas Murray, et ux, by deed bearing dated December 12, 1949, and of record in the Office of the Clerk of the County Court of Monongalia County, West Virginia, in Deed Book No. 452, at page 111.

There is also granted and conveyed to the Grantee herein, their successors, heirs and assigns, an easement and right of way 15 feet in width which lies along the southern boundary of said property herein conveyed and extends the full length of that property owned by Elmer C. Murray.

Said easement or right of way is more fully described and labeled “15.00’ R/W” on the said plat which is attached hereto for a more particular description of said easement and right of way.

There is further granted and conveyed to the Grantees herein, their successors, heirs and assigns, a easement and right of way for that certain water line which lies along the above stated right of way and runs through property conveyed herein and other property owned by the Grantors. It is to be understood that the Grantees shall the right to construct, use, maintain, repair and replace said water line in its present location.

It is to be understood that said right-of-way and easement shall be over and through the; above described area for the purposes of ingress and egress to Grantees’ property, and shall be used in common with the Grantors herein, their successors, heirs and assigns, and all other persons who may own any of the property now owned by the Grantors herein.

It is to be further understood that said right-of-way and easement is to be used for the mutual benefit of the Grantors herein and the Grantees herein, their successors, heirs and assigns shall not at any time be obstructed or blocked by the Grantors or Grantees herein, their successors, heirs or assigns, and shall also be binding on the successors, heirs and assigns of the parties hereto.

This conveyance is made subject to all exceptions and reservations contained in all prior deeds of conveyance pertaining to the above described real estate.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
