NOTICE OF TRUSTEE’S SALE In execution of the deed of trust, dated August 16, 2011, from Kimberly M. Martin to Gary R. Mills and Stephen M. Feola, as trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1216, at page 489, and the deed of trust, dated February 6, 2012, from Kimberly M. Martin to Gary R. Mills and Stephen M. Feola, as trustees, of record in said Clerk’s Office in Trust Deed Book 1228, at page 215, the undersigned trustee will offer for sale at public auction on February 16, 2015, at 10:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, all that certain tract or parcel of real estate together with the improvements thereon and appurtenances thereunto belonging, situate on Albemarle Street in the City of Bluefield, Mercer County, West Virginia, as shown on Microfilm Plat No. 4226, which property is more particularly bounded and described as follows: Part of Lots 1 and 2, Section 870 BEGINNING at a point at the intersection of the East line of Wythe Avenue with the North line of Albemarle Street; thence with the North line of Albemarle Street N. 48? 42′ E. 103.05 feet to a point, the Southeast corner of Lot No. 2, of said plat; thence N. 41? 18′ W. and with the line of Lot No. 3, 115 feet to a point, thence through Lots 1 and 2, S. 48? 42′ W. 100.46 feet to a point in the East line of Wythe Avenue; thence with the East line of Wythe Avenue S. 40? E. 115.03 feet to the point of BEGINNING. J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated January 6, 2015, of record in said Clerk’s Office in Trust Deed Book 1289, at page 363, and by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated January 20, 2015, of record in said Clerk’s Office in Trust Deed Book 1289, at page 514. This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the liens of the deeds of trust. TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by special warranty deed. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees.
