NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of a certain Deed of Trust (the “Deed of Trust” ) dated May 11, 2007, made by Dolan Auction and Appraisal Company, “LLC” , to Neil A. Reed and Tamera L. Sisler, Trustee, of record in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Trust Deed Book No. 439, at page 1, to secure WesBanco Bank in the payment of the sum of $98,000.00, evidenced by a negotiable promissory note bearing even date therewith, and WesBanco Bank, Inc. being authorized and empowered to designate and appoint one or more substitute trustees in the place and stead of the trustee named in the Deed of Trust and the undersigned, Christopher R. Arthur and/or James H. Adkins, were so appointed by the terms of a Designation of Substitute Trustee of record in said Clerk’s office, and default having been made in the payment of said indebtedness and said Substitute Trustees having been requested in writing so to do by WesBanco Bank, Inc. owner and holder of said note, said Substitute Trustees, on

will offer for sale and sell at public auction at the property location of Route 92, Reedsville, West Virginia to the highest bidder therefore, which is comprised of all of his right, title and interest, in and to being all those certain lots and parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the Town of Reedsville, Preston County, West Virginia, more particularly described as follows:

PARCEL NO. 1:

Beginning at a stake on the Ices Ferry Pike (State Route No. 92) and corner of Cross Street, and running thence with Cross Street on the southwest side thereof, N. 48° W. 137.6 feet to an iron pin, the third corner of a lot conveyed to I. G. Morgan by Farmers’ & Merchants’ Bank by deed dated March 12, 1930, and of record in the office of the Clerk of the County Commission of Preston County, West Virginia, in Deed Book No. 176, at page 365, and running thence with said I. G. Morgan’ s line through original Lot Nos. 3 and 4, S. 42° W. 132.4 feet to a stake; thence S. 48° E. 137.6 feet to a stake in a line with the Tunnelton and Ices Ferry Pike; thence with said Pike, N. 42° E. 132.4 feet to the place of beginning, and being all of the remainder of Lot Nos. 3 and 4.
PARCEL NO. 2:

Tract No. 1: Beginning at a stake at the end of the first line of Lot No. 4, as described in a deed from Farmers’ & merchants’ Bank to I. G. Morgan dated the 12th day of March, 1930, and recorded in Deed Book No. 176, at page 365, of the land records of Preston County, said stake being a corner of Cross Street and Long Alley, thence with line No. 2 of said deed description and Long Alley, S. 42° W. 92.40 feet to a stake; corner to Lot No. 3; thence with a portion of line of Lot No. 3 of said deed description, S. 48° E. 92.40 feet to an iron pin standing in the first line of said deed description; and thence with a portion of said first line of said deed description; and thence with a portion of said first line and Cross Street, N. 48° W. 100 feet to the beginning, containing 0.212 acres, more or less, and being a portion of Lot No. 4.

Tract No. 2: Beginning a stake at the end of the second line of Lot No. 3, ad described in a deed from Farmers’ & Merchants’ Bank to I. G. Morgan, dated the 12th day of March, 1930, and recorded in said County Clerk’ s Office in Deed Book No. 176, at page 365; thence with line No. 3 of said deed description and Long Alley, S. 42° W. 40 feet to a stake; thence with a portion of line No. 4 of said deed description S. 48° E. 100 feet to a stake; thence through Lot No. 3, No. 42° E. 40 feet to a stake in line No. 2 of said deed description; and thence with a portion of said line No. 2, No. 48° W. 100 feet to the beginning, containing 0.092 acres, more or less, and being a portion of Lot No. 3.

Tract No. 3: Being a part of another lot situate in the Reed Addition to the Town of Reedsville, Preston County, West Virginia, and bounded as follows: On the North and West by the M. & K. R.R. Company land; on the South by a street, thirty (30) feet frontage, extending back one hundred (100) feet; on the east by Ices Ferry and Tunnelton Pike, containing 0.069 acres, more or less, and being a portion of Lot No. 5, shown on the official map of the Town of Reedsville, as Lot No. 5A.

Being all of the same real estate that was conveyed to Dolan Auction and Appraisal Company, LLC, by Maitlin T. Cale by deed dated the 3rd day of September, 2002, which deed is of record in said Clerk’ s Office in Deed Book 634, at page 908.

This conveyance is made subject to all restrictions, reservations, conditions, exceptions, easements and rights of way as contained in all other prior deeds of record for said real estate; and there is further reserved from this conveyance all of the iron ore, coal, fire clay and other minerals, as well as oil and gas, together with mining rights as heretofore excepted, reserved or conveyed away by the Grantor’ s predecessors in title.

The sale of said property will be made subject to all exceptions, encumbrances, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, and any and all unpaid taxes assessed against said property.

Joe R. Pyle Auction Service will assist with the sale. Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustees reserve the right to reject any or all bids. Conveyance shall be by special warranty deed, and purchaser shall pay for all transfer stamps, recording fees, and other closing costs.

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the sales price shall be paid by cash, cashier’ s check, or check guaranteed by bank letter of credit in acceptable form, in hand on the day of sale (the "Good Faith Deposit"), with the balance to be paid in cash at closing within 30 days after the date of sale. Additional terms and conditions shall be announced at the sale.

At public sale any person or entity may bid and may purchase any real estate sold if they be the highest bidder. If the real estate is sold for an amount in excess of the outstanding balance of the mortgage, together with all interest, unpaid real estate taxes and costs, said excess must be used to satisfy any other encumbrances on said property and after all said encumbrances are satisfied together with all interest and costs, any excess then remaining must be paid to the Grantor. If the Grantor or any person holding an encumbrance cannot be found after a diligent search, the money shall be paid into the Circuit Court of the county for the benefit of the Grantor or the holder of any such encumbrance.
