NOTICE OF TRUSTEE’S FORECLOSURE SALE ON VALUABLE REAL ESTATE Notice is hereby given that by virtue of that certain Deed of Trust dated March 30, 2007, from D. L. Redden, Individual, to Karen Wimmer and Greg Morris, Trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1106, at page 592, and re-recorded in said Clerk’s Office in Trust Deed Book 1119, at page 198, the Note therein secured being in default, and the undersigned having been appointed Substitute Trustee, pursuant to a Substitution of Trustee dated February 26, 2013, and of record in said Clerk’s Office in Trust Deed Book 1251, at page 600, the undersigned Substitute Trustee, at the request of the Noteholder, will offer for sale and sell at public auction on March 17, 2015, at 9:30 o’clock a.m., at the Front Door of the Mercer County Courthouse (being the North Walker side), at Princeton, Mercer County, West Virginia, the following described real estate, to-wit: “All of that certain tract or parcel of real estate designated as Unit 20 on “PLAT OF SURVEY SHOWING AN ADDITION TO RED-ROB COVE SUBDIVISION, SITUATE IN THE CITY OF PRINCETON, MERCER COUNTY, WEST VIRGINIA. DATE 10/11/05 SCALE 1″ = 30′ TAX MAP NO. 19, PARCEL 80”, said plat of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia as Microfilm Plat No. 15605 to which reference is hereby made for all pertinent purposes, and which parcel is more fully bounded and described as follows: “BEGINNING at a point on the north line of Jesse-Justin Street, said point being the southwestern corner of Unit 21, thence with the northern line of Jesse-Justin Street, S. 79? 49′ 37″ W. 25.48′ to a point; thence, N. 9? 28′ 33″ E. 102.67 feet to a point; thence, S. 80? 18′ 50″ E. 24.00 feet to a point; thence with the division line between Unit 20 and Unit 21, S. 9? 28′ 33″ W. 94.01 feet to the place of BEGINNING.” At the time of the execution of the Deed of Trust, this property was reported to have an address of 1412 Justin Jesse Street, Princeton, Mercer County, West Virginia. The above-referenced real estate will be conveyed with no covenants of warranty and subject to all covenants, restrictions, easements, rights-of-way, and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances including, without limitation, liens for real estate taxes, sanitary and sewer charges. In the event there are federal tax liens against the property, the United States would have the right to redeem the property within 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The terms of the Sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note). Said real estate will be sold by said Trustee in “AS IS” condition, subject to all taxes now due or to become due on said property, all liens, out conveyances, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and other matters of record in said Clerk’s Office affecting the title to said property. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, grantor’s tax, and recording fees. The Trustee reserves the right to continue the Sale or to adjourn same for a time, or from time to time, without further Notice by announcement at the time and place of said Sale hereinabove set forth. THE PURCHASER, UPON PAYMENT OF THE PURCHASE PRICE IN FULL, SHALL RECEIVE FROM THE HEREINABOVE NAMED SUBSTITUTE TRUSTEE, A DEED CONVEYING THE HEREINABOVE DESCRIBED PROPERTY, WITHOUT ANY COVENANT OR WARRANTY, EITHER EXPRESS OR IMPLIED, AND SUBJECT TO THE MATTERS HEREINABOVE MENTIONED. Notice is also given that any personal property and/or belongings remaining at the property after the Foreclosure Sale will be deemed to constitute abandoned property and will be disposed of accordingly.
