NOTICE OF FIRST READING AMENDMENT

NOTICE OF FIRST READING
AMENDMENT TO EXOTIC
ENTERTAINMENT ORDINANCE

The public is hereby notified that on Tuesday, April 10, 2018 at 10:00 a.m. in the County Commission Courtroom at the Mercer County Courthouse, the Mercer County Commission will conduct the First Reading of the Amended Version of the Exotic Entertainment Ordinance originally adopted in November 2002.

The proposed revision increases the location of any exotic entertainment business from 2,000 feet to 5,280 feet of the following:

A. a church, synagogue, mosque, temple or building which is used primarily for religious worship and related religious activities;
B. a public or private education facility including, but not limited to, child day care facilities, nursery schools, preschools, kindergartens, elementary schools, private schools, intermediate schools, junior high schools, middle schools, high schools, vocational schools, secondary schools, continuation schools, special education schools, junior colleges and universities. The term “schools” includes the school grounds but does not include facilities used primarily for another purpose and only incidentally as a school;
C. a public park or recreation area which has been designated for park or recreational activities including, but not limited to, a park, playground, natural trails, swimming pool, reservoir, athletic field, basketball or tennis court, pedestrian/bicycle paths, wilderness areas or other similar public land;
D. the property line of a lot devoted to residential use;
E. a restaurant or entertainment business which is oriented primarily towards children or family entertainment;
F. licensed premises, which is licensed pursuant to the alcoholic beverage control regulations of the State of West Virginia;
G. hotel, motel, campground, bed and breakfast.
