NOTICE OF JUDICIAL SALE
Take notice that on the 1st day of July, 2021, at 12:00 p.m. until the 30th day of July, 2021, at 7:00 p.m., an online auction will take place at www.kaufmanauctionswv.com with the real estate, hereinafter described, being sold to the highest bidder. Such sale has been Ordered by the Circuit court of Marion county pursuant to civil action 11-C-333. The real estate is described as that certain tract or parcel, bearing an address of 718 Husky Highway in Fairmont, West Virginia and identified by the Marion County Assessor as being Parcel 84 on Tax Map 50 in Barrackville Corporate Tax District, and being described as follows:
Beginning at the center of Ices Run, ad running thence N. 40 1/4° E. 12-1/2 poles (heretofore erroneously stated as “20-1/2 poles”) along and to center of Fairmont and Wheeling Turnpike; thence S. 85-1/2° W. 25 poles to a stone; thence S. 6° E. 8 poles to the center of Ices Run; and thence N. 89° E. (Heretofore erroneously stated as “N. 80°E.”) 16 poles with the Run to the beginning, containing one acre, more or less.
This conveyance is subject to the following reservations, conveyances and rights of way:
A. All the coal within and underlying said tract, together with the mining rights and privileges appertaining thereto, which Moses Ice and Lydia A. Ice reserved in a Deed to Thomas J. Ice, dated May 15, 1894, of record in eh Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 123, at page 436.
B. A small triangular strip of land conveyed to C.R. Michael by Thomas J. Ice and Ollie Ice, his wife, by Deed dated August 22, 1934, of record in said Clerk’s Office in Deed Book No. 318, at page 253.
C. A right of way of easement for a road across a part of said land which Thomas J. Ice and Ollie Ice, his wife, conveyed to the County Commission of Marion County, a corporation, by Deed Book No. 304, at page 470.
D. A right of way or easement for an electric transmission line through said land which Thomas J. Ice and Ollie Ice, his wife, conveyed to Monongahela Valley Traction Company, a corporation, by Deed dated November 27, 1918, of record in said Clerk’s Office in Deed Book No. 225, at page 537.
E. A Right of way or easement for an electric transmission line through said land which Thomas J. Ice and Ollie Ice, his wife, conveyed to Monongahela West Penn Public Service Company, a corporation, by Deed dated September 19, 1934, of record in said Clerk’s Office in Deed Book No. 319, at page 26.
F. A right of way or easement through said land which Thomas J. Ice and Ollie Ice, his wife, conveyed to Clyde Ice. by Deed Dated February 1, 1938, or record in said Clerk’s Office in Deed Book No. 337, at Page 233.
Conveyance of said real estate is subject to all exceptions, reservations, rights of way, conditions, and agreements contained in prior deeds or other instruments in the chain of title, and is subject to all unpaid property taxes against said real estate.
The property will be conveyed in an “AS IS” physical condition, without warranty as to habitability or fitness.
The total purchase price is payable to Kaufman Realty by cashier’s check, cash, or the equivalent within 2 (two) days of the date of sale, with ten percent (10%) of the total purchase price payable to the Auctioneer or his agent at sale by cashier’s check, cash, or the equivalent.
