NOTICE OF PUBLIC HEARING

Public hearing for the following Ordinance will be held during the special meeting of Common Council on Tuesday, July 28, 2015 at 6:30 p.m., in Council Chambers of Beckley City Hall. All interested parties are urged to attend. AN ORDINANCE TO SELL THE NORTHEAST CORNER OF LOT 24, SECTION 6, REVISED MAP OF THE EWART HEIGHTS ADDITION WHEREAS, the City of Beckley is the owner of certain real property located in the City of Beckley, Raleigh County, West Virginia and identified as lot 24, Section 6, Revised Map of the Ewart Heights Addition, in the City of Beckley, Raleigh County, West Virginia; and WHEREAS, the City of Beckley has been asked to convey the northeast corner of this lot to the purchaser, for consideration, due to the fact that a corner of the adjacent property’s driveway has been located on this corner for approximately 50 years; and WHEREAS, the northeast corner of the lot is no longer of value to the City; and WHEREAS, the City is desirous of selling said property to the adjacent property owner for fair and adequate consideration; and WHEREAS, West Virginia Code Chapter 8, Article 12, Section 18(b), authorizes a municipality to sell real property for fair and adequate consideration without the requirement of a public auction provided that fair and adequate consideration is less than $1,000.00. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF BECKLEY: That pursuant to West Virginia Code c8-11-3 and c8-12-18(b) the Mayor and Recorder-Treasurer are hereby authorized to sell the northeast corner of Lot 24, Section 6 of the Ewart Heights Addition as shown on the attached Plat and as described in Exhibit “A” attached hereto, located in the City of Beckley, Raleigh County, West Virginia, for fair and adequate consideration. The City has determined that the property is of no value to the City. The City has further determined that fair and adequate consideration is $500.00 and the adjacent property owner has agreed to pay to the City of Beckley the sum of $500.00 as consideration for the purchase of this property. The Mayor and Recorder – Treasurer are hereby authorized to execute any and all documents required to consummate this conveyance of real property.
