PO BOX 522 RICH CREEK, VA 24147 NOTICE OF SALE Under authority of a certain Deed of Trust dated March 30, 2007, from Namaskar Enterprises, Inc., to Ned Payne and William H. File, Trustees, securing City National Bank of West Virginia in the amount of $200,000.00, of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia in Trust Deed Book 5026, at page 4467, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Notice of Substitution of Trustee dated August 16, 2016, of record in the aforesaid Clerk’s Office in Book 5063, at page 731,will offer for sale at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on the 4th day of October, 2016 at 11:00 o’clock, the certain real estate conveyed in said Deed of Trust, as described as follows: The following described real estate, located in the City of Beckley Tax District, County of Raleigh, and State of West Virginia, and more particularly described as follows: BEGINNING at the corner of Ewart Avenue and West Neville Street (also known as Harper Road); thence with the West line of Ewart Avenue N. 15 55′ 45″ W. 100.77 feet to a pin; thence continuing with the West line of Ewart Avenue N. 22 34′ 30″ W 49.23 feet to a pin, corner to remaining lands of Iva Cook Williams; thence with the line of Williams S. 82 32′ 13″ W. 138.09 feet to a pin, corner to Iva Cook Williams; thence with another line of Williams S. 15 47′ 07″ E 125 feet to a pin in the North line of West Neville Street and in the North line of a concrete sidewalk; thence with the North line of West Neville Street and along the North line of the sidewalk 150 feet, more or less, said line being a curve with a chord distance of 149.59 feet to the point of beginning. Less that area conveyed to the State Road Commission of West Virginia by deed dated April 16, 1968, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 468, at page 50. And Being the same property acquired by Namaskar Enterprises, Inc., a West Virginia Corporation, by deed dated November 16, 2006, from Bane E. Sarrett and Judith F. Sarrett, of record in aforesaid Clerk’s Office in Deed Book 5024, at page 7473. This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground. This property will be conveyed by Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property. The above-described real estate will be conveyed by the undersigned Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Trustee herein. The above-described real estate will be sold by the undersigned Substitute Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE The Substitute Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
