NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in that certain deed of trust dated May 15, 2000 from Juanima C. Jackson, a/k/a Juanima C. Smith, formerly Juanima C. Robinson to P. Michael Pleska and F. Thomas Graff, Jr., trustees to secure United Bank, Inc. and recorded in the office of the Clerk of the County Commission, Raleigh County West Virginia at Book 5002, page 2951, default having been made by the said Juanima C. Jackson, a/k/a Juanima C. Smith, formerly Juanima C. Robinson in the payment of the obligation secured by said Deed of Trust and having been requested in writing by the holder of the obligation secured, the undersigned will offer for sale at the front door of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, at 10:00 a.m. on Tuesday, January 12, 2016, that certain real estate conveyed by said deed of trust and more particularly described as follows: Situated in the City of Beckley, in the Lilly Land Company’s Addition No. 2 to the City of Beckley, Raleigh County, West Virginia, to-wit: The surface and appurtenances thereunto belonging of those certain lots or parcels of land in the City of Beckley, West Virginia, in Lilly Land Company’s Addition No. 2 to the City of Beckley, and being Lot No. 13 and the one-half of Lot No. 14 which adjoins said Lot No. 13 of Section No. 33 of said Addition, as shown by Map No. 2 thereof, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 66, at page 308, reference to which map is here specifically made. Said Lot No. 13 and the adjoining one-half of Lot No. 14 front a total of 76 feet on Seventh Street and extend back 150 feet to an alley. There is EXCEPTED and RESERVED, that part of the hereinbefore described property which was conveyed to Luther P. Miller and Lillian M. Miller, by deed dated October 10, 1960, from Emily A. Comer, recorded in the aforesaid Clerk’s Office in Deed Book No. 399, at page 535; reference is made to said deed for a more particular description of the property reserved and excepted. There is also EXCEPTED and RESERVED that part of the hereinbefore described property which was conveyed to Barry Webb and Peggy Ann Webb, his wife, by deed dated July 1, 1992, from Maye Comer Collins and Dewey Collins, her husband, recorded in the aforesaid Clerk’s Office in Roll 25, at Page 2063. And being the same property conveyed to Juanima C. Jackson a/k/a Juanima C. Smith,, formerly Juanima C. Robinson, by deed dated May 15, 2000, from John E. Flynn, Jr. and Renee Y. Jackson, (formerly Renee Y. Flynn), and recorded in the aforesaid Clerk’s Office at Book 5002, Page 2946. Under the provision of said deed of trust, the beneficial holder reserved the right to appoint a substitute trustee and the beneficial holder, United Bank, Inc., exercised said power by Appointment of Substitute Trustee dated the 7th day of December, 2015, and of record in the aforesaid Clerk’s office at Roll 5060, Page 7144, appointing the undersigned substitute trustee in the place and stead of the said P. Michael Pleska and F. Thomas Graff, Jr. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer services assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS OF SALE Cash in hand on day of sale. The above described real estate will be sold by auction to the highest bidder, subject to the right of the undersigned to reject any and all bids if, in his opinion, it is or they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have a right to bid. CONTINUANCE – ADJOURNMENT OF SALE The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time without further notice than announcement at the time and place of sale as hereinabove set forth or any continuance or adjournment thereof.
