NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in that certain deed of trust dated June 30, 1999 from Henry Mitchell Carson and Diana Rena Carson to W. A. Thornhill, III, James F. Vaughan, Jr. and Margot Bower, Trustees to secure United Bank, Inc. and recorded in the office of the Clerk of the County Commission, Raleigh County West Virginia at Roll 5000, page 1623, default having been made by the said Henry Mitchell Carson and Diana Rena Carson in the payment of the obligation secured by said Deed of Trust and having been requested in writing by the holder of the obligation secured, the undersigned will offer for sale at the front door of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, at 10:00 a.m. on Thursday, September 8, 2016, that certain real estate conveyed by said deed of trust and more particularly described as follows: The surface, together with all appurtenances and improvements thereunto belonging, of Lots Nos. 6 and 7 of the Knob Hill Land Company’s Addition to the City of Beckley, Raleigh County, West Virginia, which said Addition is now known as Hillcrest Park Addition, and said lots hereby conveyed being shown and designated as Lots Nos. 6 and 7, Section 1, Hillcrest Park Addition to the City of Beckley, Raleigh County, West Virginia, on a map of said Hillcrest Park Addition, recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book No. 7, at page 18, to which said map reference is here made for a more particular description of the property hereby conveyed. And being the same property conveyed to the grantors herein by deed from Joseph W. Nunn and Thelma Nunn, husband and wife, dated June 23, 1999, of record in the aforesaid Clerk’s Office in Deed Book 5000, page 1622. There is hereby EXCEPTED and RESERVED out of the above described tract a certain tract conveyed by Joseph W. Nunn and Thelma Nunn, his wife, to Jerry W. Nunn, by deed dated September 4, 1980, and recorded in the aforesaid Clerk’s office in Deed Book 633, at page 148, the tract hereby excepted being more particularly bounded and described as follows: BEGINNING at a stake on the northern right of way line of Odessa Avenue, said stake being where Lots Nos. 5 and 6 of Hillcrest Park Addition intersect with the northern right of way line of Odessa Avenue; thence leaving the northern right of way line of Odessa Avenue N. 13 f 12′ W. 84.50 feet to a stake; thence leaving the common boundary line of Lots Nos. 5 and 6 and through Lots Nos. 6 and 7, N. 76 f 48′ E. approximately 102 feet to the common boundary line of Lots Nos. 7 and 8 of Hillcrest Park Addition; thence with the common boundary line of Lots Nos. 7 and 8, S. 13 f 12′ E. 111.60 feet to a stake on the northern right of way line of Odessa Avenue; thence with the northern right of way line of Odessa Avenue N. 88 f 36′ W. 97.0 feet to a stake; thence continuing with the northern right of way line of Odessa Avenue S. 76 f 48′ W. 6.30 feet back to the point of beginning, containing 10,001 square feet. And said Deed of Trust contains among others the following provisions: Under the provision of said deed of trust, the beneficial holder reserved the right to appoint a substitute trustee and the beneficial holder, United Bank, Inc., exercised said power by Amended Appointment of Successor Trustee dated August 4, 2016, at Book 5062, Page 9190 appointing the undersigned substitute trustee in the place and stead of the said W. A. Thornhill, III, James F. Vaughan, Jr. and Margot Bower. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer services assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS OF SALE Cash in hand on day of sale. The above described real estate will be sold by auction to the highest bidder, subject to the right of the undersigned to reject any and all bids if, in his opinion, it is or they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have a right to bid.
