NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in that certain deed of trust dated October 12, 2004 from William J. McAndrews and Eva F. McAndrews to W.A. Thornhill, III, James Vaughan, Jr. and Margot Bower, Trustees to secure United Bank, Inc. and recorded in the office of the Clerk of the County Commission, Raleigh County West Virginia at Book 5015, page 3349, default having been made by the said William J. McAndrews and Eva F. McAndrews in the payment of the obligation secured by said Deed of Trust and having been requested in writing by the holder of the obligation secured, the undersigned will offer for sale at the front door of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, at 10:00 a.m. on Tuesday, March 3, 2015, that certain real estate conveyed by said deed of trust and more particularly described as follows: Situate in the County of Raleigh, Shady Spring District, State of West Virginia; The surface of the following described lot or parcel of land situate in Shady Spring District, Raleigh County, West Virginia, bounded and described as all of Lot No. 51 of the Pauline Holdren Addition, Town Lots and Truck Farms, as shown on a Map of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia. And being the same property conveyed to William J. McAndrews and Eva F. McAndrews, husband and wife, as joint tenants with right of survivorship, by deed dated October 13, 2004 recorded in the aforesaid Clerk’s Office at Book 5015, Page 3347. Eva F. McAndrews departed this life November 9, 2008, thereby vesting complete title to the above-described property in William J. McAndrews. William J. McAndrews departed this life January 3, 2009 and by Will dated September 4, 1997, of record in the aforesaid Clerk’s Office at Book 5034, Page 3335, devised the above-described property to Dinina and Ronald Mercer. By deed dated May 6, 2009, recorded in the aforesaid Clerk’s Office at Book 5035, Page 8082, Ronald Mercer and Dinina Mercer, his wife, conveyed the above-described property to Sylvia Gaye Alexander and by document dated January 19, 2009, of record in the aforesaid Clerk’s Office, Ronnie and Dinina Mercer assigned their position as Co-Executors of the Estate of Eva McAndrews and William J. McAndrews to Sylvia Gaye Alexander. Under the provision of said deed of trust, the beneficial holder reserved the right to appoint a substitute trustee and the beneficial holder, United Bank, Inc., exercised said power by Appointment of Substitute Trustee dated the 27th day of January, 2015, and of record in the aforesaid Clerk’s office at Book 5057, Page 6953, appointing the undersigned substitute trustee in the place and stead of the said W. A. Thornhill, III, James Vaughan, Jr. and Margot Bower. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer services assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS OF SALE Cash in hand on day of sale. The above described real estate will be sold by auction to the highest bidder, subject to the right of the undersigned to reject any and all bids if, in his opinion, it is or they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have a right to bid. CONTINUANCE – ADJOURNMENT OF SALE The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time without further notice than announcement at the time and place of sale as hereinabove set forth or any continuance or adjournment thereof.
