NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in the certain Deed of Trust from Robert A. Plumley, III and Joanne Lynn Plumley, husband and wife, dated November 30, 2012 to Thomas G. Truman and Robert B. Sayre, Trustees, to secure Thearn H. Ellis, Jr., and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5049, page 6323, and default having been made by the said Robert A. Plumley, II and Joanne Lynn Plumley in the payment of the obligation secured by said Deed of Trust and sale having been requested in writing by the beneficial holder of the obligation secured, the undersigned will offer for sale at the main door of the RALEIGH COUNTY COURTHOUSE, 215 MAIN STREET, BECKLEY, WEST VIRGINIA, at 10:00 a.m. on the 20th day of July, 2015, the following described property, together with the improvements thereon and appurtenances thereto belonging, situate in the Town of Mabscott, Raleigh County, West Virginia, and more particularly described as follows: Being Lot No. 11, Section 5 of East Wickham, a map of said East Wickham being recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 62, at page 192. There is EXCEPTED AND RESERVED from this conveyance, that part of Lot No. 11, Section 5 of East Wickham that was conveyed to Ernest G. Gadd and Eileen H. Gadd, his wife, by Deed dated October 26, 1972, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 519, at page 513, and reference is made to said Deed for a more particular description of the property reserved and excepted. And being the same property conveyed to the said Robert A. Plumley, II and Joanne Lynn Plumley from Thearn H. Ellis, Jr., by Deed dated October 30, 2012 and recorded in the aforesaid Clerk’s Office in Book 5049, at page 6322. Under the provisions of West Virginia Code c 38-1-13, the beneficial holder is entitled to appoint a substitute trustee upon the resignation of trustee. Thomas G. Truman and Robert B. Sayre resigned as Trustees on April 28, 2015 and the beneficial holder, Thearn H. Ellis, Jr. exercised said power by Notice of Appointment of Substtitute Trustee dated April 28, 2015 and of record in the the aforesaid Clerk’s Office in Book 5059, at page 31, appointing the undersigned substitute trustee in the place and stead and the said Thomas G. Truman and Robert B. Sayre. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer serves assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property, including but not limited to those reservations and exceptions set forth in the above referenced Deed. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The subject property is reported to have a street address of 105 Spruce Street, Mabscott, West Virginia 25871. TERMS OF SALE Cash in hand on day of sale. The above described real estate will be sold by auction to the highest bidder, subject to the right of the undersigned to reject any and all bids if, in his opinion, it is or they are inadequate. The owner of the indebtedness secured by the above described Deed of Trust and the owner of any other interest in the property to be sold shall have a right to bid. CONTINUANCE – ADJOURNMENT OF SALE The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time without further notice than announcement at the time and place of sale as hereinabove set forth or any continuance or adjournment thereof.
