NOTICE OF SALE OF REAL ESTATE

Notice is hereby given that in accordance with an Order of the Circuit Court of Wood County, West Virginia, Civil Action No: 19-C-153, C. Blaine Myers, Special Commissioner, shall offer for sale at the front door of the Wood County Courthouse, 1 Court Square, Third and Market Streets, Parkersburg, Wood County, West Virginia, on October 7, 2019, at 10:00 a.m. certain real property located in the City of Williamstown, Wood County, West Virginia, more particularly described as follows:

Fronting fifty (50) feet on the west side of Columbia Avenue and running thence in a westerly direction with the same width 130 feet, running with the south line of Elm Street to Plum Alley, the same being Lot No. 28 in the Whitten Stewart Addition to Williamstown, a Plat of which Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 91, at Page 516, to which Plat reference is hereby made.

Said property is further identified as Lot #28 Whitten Stewart Lane, Map 7, Parcel 064, illiamstown District, Wood County, West Virginia, with a physical address of 600 Columbia venue, Williamstown, West Virginia.

Said property shall be offered for sale to the highest bidder, subject to confirmation by Order of the Circuit Court of Wood County, West Virginia. The following terms will apply to said sale:

1. A deposit of ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) percent of the purchase price on the day of sale shall be required, with the balance to be paid within a reasonable time as determined by the Special Commissioner and Purchaser, and as approved by the Court.
2. The sale is subject to any and all reservations, exceptions, conditions, grants of rights of way and easements by the current owners and their predecessors in title.
3 The undersigned reserves the right to adjourn the sale from day to day and from time to time upon oral proclamation made at the time and place of sale set forth herein.
4. The undersigned reserves the right to reject any and all bids.
5. Sale is subject to unpaid ad valorem taxes and special assessments, if any.
6. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the undersigned shall have the option to consummate sale with the next highest bidder at the sale.
