NOTICE OF SALE
UNDER DEED OF TRUST
Under authority of a certain Deed of Trust from Joshua W. McDaniel, dated the 31st day of August, 2016 to Alan H. Larrick, Trustee, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5063, at page 2004; default having been made in the payment of the obligation secured by said Deed of Trust and sale having been requested in writing by the holder of the obligation secured; and A. David Abrams, Jr. having been substituted as Trustee under a Notice of Appointment of Substitute Trustee dated October 31, 2018 and recorded in the County Clerk’s Office in Book 5068, at Page 5798 the undersigned will offer for sale at the front door of the Courthouse of Raleigh County, Beckley, West Virginia, at 9:00 a.m. on Thursday, December 27, 2018, that certain real estate conveyed by said Deed of Trust as described on the Exhibit A attached hereto and made a part hereof.

PROPERTY DESCRIPTION FOR
JOSHUA W. MCDANIEL
All of that certain lot, tract, or parcel of land, together with all improvements thereto and easements and appurtenances thereto, situate in Shady Spring District, Raleigh County, West Virginia, and being more particularly described as follows:
Surface and that certain lot, being Lot No. 19 of Phase 1 of the Blue Jay Recreation Association, Inc., more particularly shown and described on that survey map which is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5016, at page 1027, which map is entitled “Map Showing Lots No. 1 Thru No. 47 Prepared for Blue Jay Recreation Association, Inc.” as prepared by ESI, Inc., and dated August 23, 2004.
And being the same property acquired by Joshua W. McDaniel, by Deed dated August 22, 2016 from Amanda C. McDaniel, formerly known as Amanda C. Hess, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith; and further being the same property acquired by Amanda C. Hess, by Deed dated August 17, 2010 from Craig L. Bowling and Stephanie R. Bowling, recorded in the aforesaid Clerk’s Office in Deed Book 5040, at page 7387.
And being the same property heretofore acquired by Joshua W. McDaniel, by Deed dated the 22nd day of August, 2016, from Amanda C. McDaniel, formerly known as Amanda C. Hess and which Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Book 5063, at page 2002.
The above described real estate will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and made subject to all property taxes, prior liens, including any liens for sewer service assessed by any municipality or public service district, reservations, encumbrances, restrictions, right of way, easements, covenants, conveyances and conditions of record in said Clerk’s Office and affecting the subject property.
The subject property will be sold in AS IS condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS OF SALE
Cash in hand on day of sale. The above-described real estate will be sold by the undersigned by auction to the highest bidder subject to the right of the undersigned to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have the right to bid.

ADJOURNMENT OF SALE
The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice than announcement of the time and the place of sale as hereinabove set forth for any continuance or adjournment thereof.
