NOTICE OF SALE UNDER DEED OF TRUST Under authority of a certain Deed of Trust from Richard David Mills, II and Marvin Eugene Mills, dated the 3rd day of November, 2010 and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5041, at page 3633; default having been made in the payment of the obligations secured by said Deed of Trust and sale having been requested by the beneficial owner; A. David Abrams, Jr. having been substituted as Trustee under a Notice of Appointment of Substitute Trustee dated March 12, 2014 and recorded in the County Clerk’s Office in Book 5054, at page 7446, the undersigned will offer for sale at the front door of the Courthouse of Raleigh County, Beckley, West Virginia, on Tuesday, June 30, 2015 at 9:30 o’clock a.m., that certain real estate conveyed by said Deed of Trust as described on the Exhibit A attached hereto and made a part hereof. EXHIBIT “A” The surface of that certain tract or parcel of land situated in Fairview Addition, Town of Sophia, Sophia District, Raleigh County, West Virginia, as shown on a map thereof recorded in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Deed Book 142, at page 223, and being more particularly described as follows: Said Lot front 71.88 feet on Oak Avenue, and extends back therefrom with Lot 68 a distance of 185.87 feet to Maple Avenue, and extends back on the opposite side a distance of 148.77 feet to said Maple Avenue, bordering thereon 58.1 feet. And being the same property conveyed to Richard David Mills, II and Marvin Eugene Mills, by Deed dated the 3rd day of November, 2010, from Mark Stiles, which Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5041, at page 3631. The above described real estate will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and made subject to all property taxes, prior liens, including any liens for sewer service assessed by any municipality or public service district, reservations, encumbrances, restrictions, right of way, easements, covenants, conveyances and conditions of record in said Clerk’s Office and affecting the subject property. The subject property will be sold in AS IS condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS OF SALE Cash in hand on day of sale. The above-described real estate will be sold by the undersigned by auction to the highest bidder subject to the right of the undersigned to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have the right to bid.
