NOTICE OF SUBSTITUTE TRUSTEE’S SALE In accordance with the terms of that certain Deed of Trust made by Diane White, single, to Edward P. Stansbury and/or James G. Anderson, III, either of whom may act, Trustees, parties of the second part, dated November 11, 2003, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, as Instrument 5011- 1794, given to secure a certain note set forth and described therein; and default having been made in the payment of said note, and demand having been made upon the undersigned Trustee to sell in accordance with the terms of said Deed of Trust, the undersigned Trustee, acting pursuant to the power of sale conferred in that trust deed will, on the 3rd day of March, 2015, at 10:30 a.m. at the front door of the courthouse of Raleigh County, West Virginia, sell the following described property: The following described tract of surface land, with any appurtenances thereunto belonging, situate in or near the City of Beckley, Raleigh County, West Virginia in the BECKLEY COURT ADDITION to the said City, and shown and designated as Lot Twelve (12) of Section No. Two (2), and being more particularly bounded and described as follows: Said lot fronts on First Avenue, and extend back therefrom between parallel lines a distance of 120 feet to an alley. And being the same property conveyed to Leroy J. Sorrell and Diane White, brother and sister, by Deed dated the 29th day of August 1994, by Lois L. Holmes and James Holmes, her husband, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Roll 61, Page 667, and further being the same property in which Leroy Junior Sorrell conveyed his interest to Diane White, by Deed dated November 11, 2003, recorded in the aforesaid Clerk’s Office as Instrument 5011-1793. The records reflect Diannah Mae White (who is the same person as Diane White) departed this life intestate on 04/28/2012, leaving as her sole and only heir at law, to inherit her interest in the subject property, her son, James Jackson. The undersigned was appointed and substituted as Trustee under the above referenced trust deed by an appointment of substitute trustee executed and recorded on January 14, 2015 in the Office of the Clerk of the County Commission of Raleigh County, as Instrument 5057-5796. Said sale shall be made upon the following terms and conditions: 1. Cash in hand on day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserves the right to submit a bid for the property at sale. 4. The Substitute Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Substitute Trustee. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property. 6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property.
