NOTICE OF TRUSTEE SALE Notice is hereby given that by virtue of that certain Deed of Trust dated July 12, 2012, executed by James K. Carman and Charlotte J. Carman, husband and wife, unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5048 at Page 4294, the makers of the Note and obligation secured thereby having failed to pay the same as provided for under the terms of said Note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the Note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on April 29, 2016, at 10:00 a.m. of that day at the front door of the Courthouse of Raleigh County, Beckley, West Virginia, the following described real estate, to-wit: The following described tract or parcel of land, situated in Town District, Raleigh County, West Virginia: BEGINNING at a fence post, a common corner of a tract of land containing five acres conveyed by Tolbert, Callaway & Stansbury, Inc., a corporation, to K.E. Surgough, and land owned by Kirby (formerly Price), said fence post being also on the northern right of way line of a 25-foot street; thence from the property boundary line between said five-acre tract and Kirby (formerly Price) N 31 f 45′ W 220.00 feet to a stake; thence passing through the said five-acre tract , N 58 f 15′ E 125.00 feet to a stake in a fence line, said stake being in the property boundary line between said five-acre tract and land owned by Bard of Education of Raleigh County; thence following the property boundary line between said five-acre tract and land owned by Board of Education of Raleigh County, S 31 f 45′ E 220.00 feet to a stake in said northern right of way line of a 25-foot street; thence following said northern right of way line of a 25-foot street, S 58 f 15′ W 125.00 feet to the point of beginning, containing 26,500 square feet. Being the same property conveyed to James K. Carman and Charlotte J. Carman, husband and wife, by Deed from Gerald Kay Crawford, dated November 7, 2003, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5011, at Page 1251.
