Notice is hereby given that by virtue of that certain Deed of Trust dated October 16, 2009, executed by Bruce C. Gowans, Jr. and Barbara J, Finstad. unto J. Michael Anderson, Substitute Trustee, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 659 at Page 131, the makers of the note and obligation secured thereby having failed to pay the same as provided for under the terms of said note and Deed of Trust, and default not cured within the terms of said note and Deed of Trust, the holder of the note having declared the whole thereof to be due and payable and having requested the undersigned, in writing, to make sale of the real estate described in said Deed of Trust, I will sell at public auction to the highest bidder on July 30, 2015, at 9:00 AM of that day at the front door of the courthouse of Greenbrier County, Lewisburg, West Virginia, the following described real estate, to-wit:
All that certain lot, tract or parcel of land together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereunto belonging, situate in Meadow Bluff District, Greenbrier County, West Virginia, and more particularly bounded and designated as follows: /
Beginning at 5/8″ re-bar and cap set in .the southeastern R/W of WV County Route 1, a corner to Tract Two thence leaving Tract Two and with said R/W
N 26°22’51” E 126.62 feet to a 5/8″ re-bar and cap set. a corner to Paul Dailey, Jr. thence leaving Route 1 and with said Dailey
S 63°05’05” E 227.10 feet to a fence post found in the northwestern R/W of C & O Railway Co; thence leaving Dailey and with said C & O Railway Co.
S 29°18’49” W 313.67 feet to a 5/8″ re-bar and cap set, a corner to Tract Two; thence leaving C & O Railway Co. and with said Tract Two
N 14°22’16” W 166.84 feet to a 5/8″ re-bar and cap set; thence continuing with Tract Two
N 32°12’29” W 119.67 feet to the place of beginning and containing 1.053 acres, more or less, according to a survey made by N. Eugene Kelley in June 2006 and shown as Tract One on Plat entitled “Plat of Survey for Kenneth Yoakum”.
And being the same real property conveyed unto Bruce C. Gowans, Jr. and Barbara Finstad by deed dated October 13, 2009, from Kenneth H. Yoakum, recorded in the aforesaid clerk’s office.
TERMS OF SALE: Cash in hand paid on day of sale subject to all unpaid property taxes, restrictive covenants, reservations, and easements.
