NOTICE OF TRUSTEEáS SALE

 

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Kelly M. Greathouse, to R. Vance Golden, III and Susan L. Petrella, Trustee(s) dated September 26, 2013, and recorded in the office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 1789, at page 9, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated March 13, 2018, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on May 3, 2018 at 8:50 a.m., at the front door of the courthouse of Wood County, West Virginia, the real estate conveyed by said deed of trust and situate in Clay District, Wood County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was 43 Elm Street, Davisville, WV 26142 and being more particularly bounded and described therein as follows:

 

Situate in the District of Clay, County of Wood and State of West Virginia, more particularly bounded and described as follows:

 

BEING all of Lot No. 14 of Community Acres Fifth Addition as shown and described on a plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 18, at page 54.

 

There is excepted and reserved herefrom, a right of way 10 feet wide over and across each of the above described lots from the right of way line of the street on which each of the lot fronts to the dwelling situate on each lot, for the purpose of maintaining, replacing and reconstructing the water and sanitary sewer lines which W. J. Somerville and Hazel M. Somerville have constructed over and across each lot.

 

This conveyance is expressly made subject to the rights of way and easements of record and to the restrictive covenants set forth on the Plat of Community Acres Fourth Addition, of record in Plat Book 17, at Page 4; to the Declarations of Covenants and Restrictions dated September 1, 1976, of record in Deed Book 679, at Page 80; and to the Supplemental Declaration of Covenants and Restrictions dated July 9, 1981, of record in Deed Book 758, at Page 44.

 

Being the same property conveyed to Kelly M. Greathouse from James O. Gainer by deed dated September 25, 2013, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 1205, at page 233.

 

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an âAS ISã condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

Pursuant to the terms of said deed of trust, the Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of the sale.
