NOTICE OF TRUSTEEáS SALE

 

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 27, 2006, executed by Borrowers, Donald I Dailey and Edna M Dailey, to Tommy Dixon, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1368, at Page 380. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2555 Lark Mead Rd, Parkersburg, WV 26101. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 23, 2018, of record in the Clerk’s Office in Book 2013, Page 678. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

18th day of June, 2018 at 11:15 a.m.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and being more particularly described as follows:

 

BEGINNING at a stone corner to Lot No. 1 in the Sole line; thence with said Sole line N. 83-1/4õ E. 41 poles to a stake corner to Sole land; thence with another of said Soleás lines N. 21-1/2õ E. 8 poles to a rock and Elm corner to Ben Davis place (now John Solesás); thence with said Soleás line S. 76-1/2õ E. 2 poles to the center of the public road; thence running over Lot No. 2, eight courses as follows: S. 1õ E. 20 poles to a pine, near a spring; S. 8õ 30á W. 8 poles to a pine; S. 52õ 30á W. 7.9 poles to a hickory; S. 10õ W. 17 poles to a pine; S. 5õ W. 9 poles to a pine; S. 20õ W. 11 poles to a stone; S. 24õ E. 14 poles to a stone; S. 82õ W. 24 poles to a pine in the westerly line of Lots Nos. 1 and 2, N. 11õ W. 76.7 poles to the place of beginning, containing 17 acres, be the same, more or less.

EXCEPTING therefrom that certain One Acre tract conveyed to Paul Morehead, Jr. and Cheryl A. Morehead by deed dated January 25, 1999, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 993, at page 249.

BEING part of the same real estate conveyed to Donald I. Dailey and Edna M. Dailey, husband and wife, by deed dated September 30, 1978, and of record in the aforesaid Clerkás Office, in Deed Book 713, at Page 482.

This conveyance is made subject to all rights of way, easements, restrictions and reservations, including but not limited to restrictive and protective covenants and oil, gas and mineral reservations, exceptions and leases of record appearing in the chain of title.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
