NOTICE OF TRUSTEES’ FORECLOSURE SALE ON VALUABLE RESIDENTIAL REAL ESTATE Property Address: 360 Mont Phillips Road Shady Spring, WV 25918 Upon notification by the holder of a Note secured by the Deed of Trust described below of a default and having been requested to institute these proceedings, and by virtue of the authority vested in Gary R. Mills and Scott M. McCullulloch under that certain Deed of Trust dated the 1st day of October, 2004, executed by Steven D. Gregory and Gayle H. Gregory unto Gary R. Mills and Scott M. McCullulloch, and which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Trust Deed Book 5015 at page 3561, which said Deed of Trust secured First Community Bank. A Substitute Trustee was recorded for the said Deed of Trust substituting Thomas S. Lilly and Phillip B. Ball, as Trustees, which said Substitution of Trustees is recorded in the said Clerk’s Office in Book 5058 at page 5726. The property was further secured by, and default has also occurred under Deed of Trust dated December 13, 2010, executed by Steven D. Gregory and Gayle H. Gregory and which said Deed of Trust is recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 5042, at Page 272, which said Deed of Trust secured First Community Bank. A Substitute Trustee was recorded for the said Deed of Trust substituting Thomas S. Lilly and Phillip B. Ball, as Trustees, which said Substitution of Trustees is recorded in the said Clerk’s Office in Book 5058 at page 5727. ON THE 28th DAY OF DECEMBER, 2015 AT 2:00 P.M., at the front door of the Raleigh County Court House at Beckley, Raleigh County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to wit: The surface of the following described tract of real estate situated in Shady Spring District, Raleigh County, West Virginia, and being Parcel No. 13, as shown on a map entitled “MAP OF PARCEL NO. 11-14 TRACT NO. 1 OF THE ORIGINAL THEODORE MEADOR PROPERTY OWNED BY ILOW & NORMA MEADOR, SHADY SPRING DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, SCALE 1″ = 100′ SEPT 16, 1976, PREPARED BY SOUTHERN SURVEYING & ENGINEERING INC., BECKLEY, WEST VIRGINIA HAROLD R. SNODGRASS LLS 359,” which said map is recorded on the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 12, at page 89. The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note) and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate. In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer. Notice is also given that any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
