NOTICE OF TRUSTEES’ SALE

 

Pursuant to the authority vested in the undersigned Trustees, by a Deeds of Trust dated the 20th day of April, 2004 and the 16th day of October, 2006, executed by Robert S. Bhavnani, to Paul J. Gray, Substitute Trustee, which said Deeds of Trust are of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book No. 1204, at Page 106 and No. 1391 at Page 441.

Robert S. Bhavnani, now deceased, has defaulted under the terms of the Promissory Notes secured by the Deeds of Trust. The debt evidenced by the Promissory Notes have therefore been accelerated by the lender, Peoples Bank, National Association.

At the request of the beneficiary, holder, and owner of the Deeds of Trust, the undersigned Trustees, through their agent, will sell at public auction to the highest bidder at 1:00 p.m., on the 20th day of July, 2015, on the steps of the Wood County Courthouse in Parkersburg, West Virginia, the following described real estate:

PARCEL ONE:

 

First Tract: BEGINNING at a point on the western side of Avery Street 400 feet from the intersection of East Tenth Street and Avery Street; thence in a western direction 125 feet to the line of a lot heretofore conveyed to Mattie E. H. Woodbridge; thence at right angles in a northern direction 50 feet to a point; thence in an eastern direction parallel to the first line 125 feet to the western line of Avery Street; thence with the line of Avery Street, in a southerly direction, 50 feet to the place of beginning, being all of Lot No. 25 in Jackson’s Addition to the City of Parkersburg, a plat of which is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 23, at page 333.

 

Second Tract: BEING Lot Number Twenty-Seven (27) of Jackson’s Addition to the City of Parkersburg, a plat of which Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 24, at page 333, to which plat reference is here made and had for a more particular description of said lot, said lot being fifty (50) feet from by one hundred and twenty-eight (128) feet deep, by actual measurement.

 

Being the same premises conveyed to Michael A. Corra, married, by Deed dated 12/23/98 and recorded 1/4/99 in Deed Book 992, Page 498, Records of the Clerk of the County Commission of Wood County, West Virginia.

 

PARCEL TWO: Situate, lying and being in the City of Parkersburg, County of Wood and State of West Virginia, described as follows:

 

BEGINNING on the west side of Avery Street above 10th Street at the southern or lower corner of the Figdor lot afterwards owned by Joe Kellar; thence with Avery Street towards 10th Street 25’ 8 1/2ã; thence at right angles and towards Market Street 119 feet to a stake on the alley; thence with the alley 26’ 4 1/2ã to the Figdor lot and with the line of Figdor lot 119 feet to the place of beginning. Said property being known and designated as 1027 Avery Street, Parkersburg, West Virginia.

 

Being the same premises conveyed to Michael E. Corra by Deed dated 12/30/03 and recorded 1/5/04 in Deed Book 1062, Page 477, Records of the Cle4rk of the County Commission of Wood County, West Virginia.

 

PRIOR INSTRUMENT REFERENCE: Deed Book 1066, Page 811, Records of the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

The above-described property is reported to have a mailing address of or is commonly known as: 1027, 1047, 1049 Avery Street, Parkersburg, WV 26101.

The real estate will be sold subject to real estate taxes assessed against the real estate, zoning regulations, prior Deeds of Trust, judgment liens, leases, including, but not limited to, oil, gas, and mineral leases, restrictions, rights-of-way, reservations, protective covenants, delinquent fees, rates and charges of any public service district, recorded or unrecorded, public utility easements and easements of record affecting the real estate.

The property is sold subject to those facts which might be disclosed by visual examination, survey, title examination or environmental audit.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

TERMS OF SALE: Cash in hand on day of sale or 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down on the day of sale and full payment within 14 days of the date of sale. Failure to tender the remaining balance of the purchase price to the Trustees within 14 days shall constitute a forfeiture of the buyer’s bid as if it were null and void and said purchaser’s down payment shall be forfeited to the Trustees for costs of sale. The Trustees does not want title to this property.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustees not appear at the time appointed for the sale and there is no notice posted of a continuance, please contact Peoples Bank, National Association, Attention: Charles Graham, at 740.373.3155. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustees. The Trustees are fully vested with the authority to sell the property as the Trustees by instrument to be recorded.
