NOTICE OF TRUSTEE’S SALE NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated April 4, 2008, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 5031, at page 1502, executed by Michele A. Stalnaker (now Koeniger) to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 20th day of November, 2015, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:10 a.m., sell the property hereinafter described, which property was conveyed in said Deed of Trust, and being more particularly described as follows: The surface of Lots 8 and 9 and parts of Lots 10, 18, 19 and 20, in Block No. 1, as the same appear on a map entitled “Map of Victory Garden Homesites, Beckley, Raleigh County, West Virginia,” recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 7, at page 156, from which it appears that said property is more particularly bounded and described as follows: BEGINNING at a stake on the southern edge of Crescent Road, the northeastern corner of said Lot 8 and the northwestern corner of said Lot 8 and the northwestern corner of Lot 7 to the east thereof; thence along the southern edge of said Road S. 89 f 27′ W. 142.64 feet to a stake; thence S. 5 f 58′ 12.8″ W. 64.88 feet to a stake; thence S. 00 f 33′ E. 215.51 feet to a stake, the southwestern corner of said Lot 10; thence N. 45 f 33′ W. 31.25 feet to a stake on the eastern edge of an asphaltic concrete road the west of the property here involved; thence along the eastern edge of said road S. 5 f 58′ 12.8″ W. 122.88 feet to a stake on the eastern edge of said road; thence N. 89 f 22′ E. 136.03 feet to a stake; thence S. 45 f 33′ E. 70.70 feet to a stake; thence southeastern corner of said Lot 8; thence N. 00 f 33′ W. 430.00 feet to the point and place of beginning. However, there is RESERVED and EXCEPTED from the operation of this deed that part of the hereinbefore described property of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book No.474, at page 542. And being the same property acquired by Michelle A. Stalnaker by Deed dated the 25th day of March, 2008 from Glenna Bales Poore (A.K.A. Glenna B. Poore), widow and single, by Diane P. Bridi and Dawn P. Cimala, her Co-Attorneys-in-Fact, which said Deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5031 at page 1494. Said property will be sold upon the following terms and conditions: 1. Cash in hand on day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property. 6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property. 7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
