NOTICE OF TRUSTEE’S SALE NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated September 3, 2012, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 5048, at page 6409, executed by Jeremy S. Testerman to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 2nd day of December, 2015, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 9:10 a.m., sell the property hereinafter described, which property was conveyed in said Deed of Trust, and being more particularly described as follows: The surface of that certain tract or parcel of land situated in Shady Spring District, Raleigh County, West Virginia, more particularly bounded described as follows: Beginning at a set stone found on line of the G. C. Hedrick Estate, said stone being a corner of Reba Wills; thence with said estate S 10 degrees 12′ 48″ W 381.28 feet to a set stone, found, said stone being a corner of Reo Bennett; thence with said Bennett N 82 degrees 57′ 06″ W 86.60 feet to a point situated on the right-of-way line of U. S. Route 19; thence with said right-of-way line the following five (5) calls: N 08 degrees 49′ 54″ E 72.52 feet to a point; N 10 degrees 50′ 42″ E 74.17 feet to a point; N 13 degrees 11′ 42″ E 109.83 feet tp a point; N 14 degrees 32′ 06″ E 74.95 feet to a point; N 13 degrees 51′ 00″ E 69.09 feet to a 3/4-inch rebar set, said rebar being a corner os said Reba Wills; thence leaving said right-of-way line and with said Wills, S 68 degrees 45′ 00″ E 73.00 feet to the point of beginning, and containing 32,395 square feet (0.744 acre), more or less. And being the same property acquired by Jeremy S. Testerman by Deed dated the 23rd day of August, 2012 from Hobert W. Mills and Wanda S. Mills, which said Deed is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5048 at page 6408. There is EXCEPTED and RESERVED from this conveyance that certain property heretofore outconveyed by Deed from Arthur M. Johnson and Florabell Johnson, his wife, dated February 26, 1999, to Gary D. Quesenberry and Kelly D. Quesenberry, his wife, recorded on Roll 154, at page 204. Said property will be sold upon the following terms and conditions: 1. Cash in hand on day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property. 6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property. 7.
