NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 26, 2007, executed by Borrower(s), Danny H. Bradley, to Philip Hereford, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5026, at Page 3274. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 182 Purity Hill Loop, Eccles, WV 25836. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 10, 2016, of record in the Clerk’s Office in Book 5062, Page 2553. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date: August 24, 2016 at 1:36 p.m. The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Trap Hill District, Raleigh County, West Virginia, and being more particularly described as follows: The surface, together with any appurtenances thereunto belonging, of the two (2) following described tracts or parcels of land situated in the Town of Eccles, Trap Hill District, Raleigh County, West Virginia, and being more particularly described as follows: TRACT NO. ONE: The surface only of that certain tract or parcel of land, together with any improvements thereon and the appurtenances thereunto belonging, located in the Town of Eccles, in Trap Hill District of Raleigh County, West Virginia, and more particularly bounded and described as follows: BEGINNING at an iron pin, a common corner to the Grantor’s lands and Lot No. 17 of The Crab Orchard Coal and Land Company Subdivision of the Surface Tracts Section No. 8, Eccles, Raleigh County, West Virginia; thence S. 66-03 E. 94,01 ft. to a point; thence S. 21-42 E. 131.59 ft. to a point; thence S 23-53 W. 131.57 feet to a point, said point being on a line of Lot No. 1, Section 8-A of said Subdivision; thence N. 67-08 W. 89.55 feet along the line of Lot 1 and the end of an alley to a point on the line of Lot No. 19, Section 8, said point being N. 23 f -53 E 6.38 feet from a common corner of Lot Nos. 19 and 20; thence with the lines of Lot Nos. 19 and 18 respectively N 23-53 E. 152.84 feet to an iron pin, said pin being a corner of Lot No. 18; thence with Lot No. 18 N. 66-03 W. 113.23 feet to an iron pin, said pin a common corner to Lot Nos. 18 end 17; thence along the line of Lot No. 17 N. 35 f -27 E. 73.90 feet to the point of beginning and containing .538 acres more or less. TRACT NO. TWO: The surface, together with any appurtenances yjereunto belonging, of Lots 18 and 19, Section 8, of the Town of Eccles, Trap Hill District Raleigh County, West Virginia, as shown on a map of said Town of Eccles of record in the Office of the Clerk of the County Commission of Raleigh County. And being the same property acquired by Danny H. Bradley, by deed dated. March 26, 2007, from Mildred Bradley, to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith; and further being the same property acquired by Danny B. Bradley and Mildred Bradley, husband and wife, by deed dated August 12, 2004, from Sharon Barron, said deed recorded in the aforesaid Clerk’s Office in Book 5015, at page 742. Being the same property conveyed to Danny H. Bradley by the Deed dated March 26, 2007 and recorded in Deed Book 5026 at Page 3272 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code c 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
